Animal, Aquaculture, Health and Welfare Legislation: Amendment: Law Drafting Instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Approval to request legislative drafting for amendments to animal and aquaculture health and animal welfare legislation in light of the UK’s decision to exit the EU.

 

 

Purpose of the Report

 

For the Minister to request legislative drafting time to make amendments to animal and aquaculture health and animal welfare legislation in light of the UK’s decision to exit the EU. 
 

Background

 

The UK’s decision to exit the European Union (EU), commonly known as BREXIT, has some significant impact for certain sectors of the economy and the legislative framework that supports it. This is particularly true of those areas covered by Protocol 3 of the UK’s Accession Treaty which includes animal and aquaculture health and animal welfare. BREXIT requires amendments to a wide range of animal and aquaculture health and animal welfare legislation to reflect the cessation of Protocol 3.    

 

Details
 

Protocol 3 of the UK Accession Treaty provides a way for the Crown Dependencies (CDs) to trade with the EU in the agri-food sector. The EU formalised the protocol in legislation (EEC/706/73) which applied the same rules to the CDs as the UK for the trade in agricultural products. These rules included veterinary legislation, animal and aquaculture health legislation, plant health legislation, marketing of seeds and seedlings, food legislation, feedstuffs legislation and quality and marketing standards.

The UK’s decision to leave the EU will end this relationship. In order to continue to trade in agricultural products, continuation or standard and equivalence, and allow movement of animals to and from the EU and other jurisdictions amendments are required to certain pieces of animal health and welfare legislation.

The Minister is recommended to request law drafting time for amendments to animal health and welfare legislation.
