A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment resolved to;

List 6 and 7 Dumaresq Street, St. Helier;
Assign a non-statutory grade 4 to them.

Reason(s) for decision:

some of the representations received in relation to this property have not, in light of the Court of Appeal judgement [2013]JCA237, been sustained; and
notwithstanding those elements of the representation which remain valid, the special interest of 6 and 7 Dumaresq Street, St. Helier as set out in the schedule and relative to the published criteria for selection, justifies their Listing in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 in particular because;
1. whilst acknowledging that nos. 6 and 7 Dumaresq Street are of lesser architectural significance than the other buildings in the group, with C19th alterations and the loss of nearly all internal historic features, both illustrate how small C18th homes could be altered to provide C19th shops with living accommodation and are, therefore, demonstrative of the way in which St Helier developed in the mid C18th; and
2. they are of particularly special historical interest, being some of the earliest post-medieval homes in town (of which there were only 400 in 1734), few of which remain; and
3. together with no. 8 Dumaresq Street they represent a small and rare surviving cluster of the ‘old town quarter’ from the C18/ early C19th with considerable group townscape value demonstrative of a key chapter in the development of the town.

Legal and resource implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 requires the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place.
