Fire and Rescue Service (Jersey) Law 2011 (Appointed Day) Act 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the draft Appointed Day Act in respect of the Fire and Rescue Service (Jersey) Law 2011.  The Act will bring the Law into force on 1 March 2012.

Reason(s) for Decision: The draft Appointed Day Act will bring into force the Fire and Rescue Service (Jersey) Law 2011, which will repeal the Fire Service (Jersey) Law 1959 and replace it with legislation that more appropriately reflects the modern role of the Fire and Rescue Service in Jersey, which extends beyond the traditional firefighting role.  It also places more emphasis on fire prevention, with a view to reducing the number of fires that occur.

Resource Implications: There are no additional financial or manpower implications arising from this decision.

Action required: The Executive Officer, Home Affairs to request the Greffier of the States to arrange for the draft Appointed Day Act to be lodged ‘au Greffe’ for consideration by the States on 21 February 2012.

Fire and Rescue Service (Jersey) Law 2011 (Appointed Day) Act 201-

 

The Fire and Rescue Service (Jersey) Law 2011 (‘the Law’) was approved by the States of Jersey on 19 July 2011.  It subsequently received Privy Council approval on 16 November 2011. 

The Law updates the statutory requirement to provide for the maintenance and functions of the States of Jersey Fire and Rescue Service.  It will replace the Fire Service (Jersey) Law, 1959 which was introduced at a time when the Service was only expected to focus on fighting fires; since then, the role of the Service has changed significantly.

The new statutory requirements and revisions in the Law are already being delivered by the Fire & Rescue Service, who are trained and equipped to deal with a wide range of emergencies but without any statutory requirement to do so.  Existing powers already enable a firefighter to do whatever he or she believes to be necessary to extinguish or prevent a fire.  The Law expands these powers, supporting the operational activities of a firefighter at road collisions, land and sea rescues and other emergencies.

This new framework of powers and duties will equip Jersey’s Fire & Rescue Service to meet future challenges.  It enables the Minister to decide, in consultation with the community, how and where to deploy the Service’s resources.  The Law therefore provides a stronger basis for the Service’s ability to respond to the range of risks.  It also imposes on the Minister for Home Affairs a range of statutory duties to promote fire safety, and to prepare for fighting fires and protecting people and property from fires; rescuing people from road traffic collisions; dealing with inshore sea rescues, cliff rescues and firefighting at sea; and dealing with other specific emergencies, such as flooding or terrorist attack, which may be specified by Order and can be amended in line with how the role of the Service may change in the future.

There are two subordinate Orders, which will come into force in line with the Law.  These are the Fire and Rescue Service (Charges) (Jersey) Order 201- and the Fire and Rescue Service (Emergencies and Humanitarian Services) (Jersey) Order 201-.

The draft Appointed Day Act will bring the Law into force with effect from 1 March 2012.

 

Recommendation

It is recommended that the Minister approves the draft Appointed Day Act and requests the Executive Officer, Home Affairs, to liaise with the Greffier of the States with a view to lodging the draft Act for debate by the States on 21 February 2012.
