Police Headquarters and Green Street Car Park Extension: Tender and Drawings Approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

(a)   In accordance with paragraph 1 (d) of Standing Order 168, the Minister approved drawings and specifications listed below all showing the proposed works to new Police HQ Building on Route de Fort and the extension to the existing multi-storey car park at Green Street, St Helier.

(b)   The Minister agreed to accept the lowest fixed price tender submitted by RoK-Regal Limited in the sum of £20,427,869.00 for New Police HQ and car park extension; and enter into a formal JCT 80 Contract.

Reason(s) for Decision:

The drawings noted in item (a) above and which Bye-Law approval have been granted (Permits B/2014-0120 and B/2014-0121 refer) reflect the use for which the funding is provided.

Under Standing Order 168 (1) (d), it is a requirement for the Minister for Treasury and Resources to approve plans for the construction (or alteration) of buildings where the work is to be funded wholly or partly by money voted by the States.

The estimated total cost for the works for both elements (including the lowest tender received, professional fees and other costs), as designed, can be completed within the allocated budget.

The lowest fixed price tender submitted by Rok-Regal in the sum of £20,427,869.00 can be accepted and a contract entered into.

This course of action was agreed by the Police Headquarters Steering Group at its meeting on 16th September 2014.

Resource Implications:

The budget is comprised of capital budgets relating to Police HQ (FXA025) and the extension of Green St car park (FXA062).

Other than those noted in the report, there are no further financial or manpower implications.

Action required:

The Director of Estates, JPH to finalise the pre-contract details and to sign the Contract and any other associated documentation.
