Road Racing (Karts) (Jersey) Order 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Road Racing (Karts) (Jersey) Order 2014 as prepared on behalf of Transport and Technical Services, as the administering authority of the Motor Vehicle Races (Jersey) Law 1946.

 

Reason(s) for Decision: Further to MD-T-2014-004, enabling preparation of the Order, the Minister accepted that the proposed road closures and associated traffic management were both reasonable and justified.

Action required: To notify the Publications Editor and the Law Draftsman that the Order has been made, forward the signed and sealed Order to the Publications Editor, States Greffe, and request the Greffier of the States to arrange for its notification to the States.

THE JERSEY KART AND MOTOR CLUB’S APPLICATION TO HOLD KART

 

RACING AT SOREL POINT  IN 2014

 

 

Purpose of the Report

 

To accompany the signature copy of the Road Racing (Karts) (Jersey) Order 2014 enabling the closure of the Sorel Point Loop Road (St. John) and the holding of kart racing events (including: practices) during 2014.

 

 

Background

 

The Jersey Kart & Motor Club (the Promoter) has submitted details of its proposed kart racing schedule for 2014. The races are enabled by Order of the Minister for Transport and Technical Services under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

 

The Promoter has gained the support of the Parish of St John for the races. They have also supplied proof of Public Liability Insurance.

 

 

Discussion

 

Further to MD-T-2014-0004 the Promoter, after consultation with the Connétable of St John, asked for a minor change to the event schedule for 2014. TTS officers deemed that the changes were minor, and as such have included the changes into the Road Racing (Karts) (Jersey) Order 2014.

 

The Club is proposing to hold twelve single day & two, two day racing events this year, between 22 March and 21 September (see attached schedule), similar to previous years. The Club has also requested three ‘alternative’ race dates to be used in the event that the championship season overruns due to bad weather cancellations. This means that the last possible race date is Sunday 26 October.

 

The Club has requested road closure times between 8am and 6pm on race days, although actual racing will not start until 10am, with it finishing at approximately 5pm. This is the closure duration which was granted last year.

 

 

Recommendation

 

The Minister is recommended to make the Road Racing (Karts) (Jersey) Order 2014 as prepared.

Further to MD-T-2014-0004, enabling preparation of the Order and following statutory consultations, the proposed road closures and associated traffic management are reasonable and justified.
