Store/Garage to the north of St Ives, Route de beaumont, St. Peter - maintain refusal

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Comments on Case

C5 does allow for the conversion of existing buildings to residential use. However, the existing building measures approximately 6.5m x 6.5m and the extension is almost the same size. A timber structure has been removed from the southern side of the existing building. This shed was erected without consent a few years ago and in 2003 the Department required it to be removed.

The agent refers to the size of the approval on the house at St Ives, to the south west of the site and that not enough consideration has been given to the extent of the existing building.

Our aerial photos of 2003 and 2006 show the buildings clearly along with a photo on file of the timber structure.

Approval was first granted for a replacement dwelling under the 1987 plan. In 2003 the Committee, under the Island Plan 2002, decided it would honour the original permission even though the permission had expired.

A letter of representation has been received from the new owners of St Ives.

Although the site is below the level of La Route de Beaumont, and is well screened, the starting point of C5 is that there is a presumption against development for whatever purpose.

Whilst the conversion of an outbuilding to residential can be acceptable, there are no grounds for the construction of an extension that almost doubles the size of the existing outbuildings as this is outside the spirit of C5.
