Road Traffic (Public Parking Places) (Jersey) Order 2006: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY)

 

ORDER 2006

 

 

Purpose of the Report

 

To change the maximum stay period in St Brelade’s Church Car Park at top of the Slip in St Brelade to a maximum stay period of 12 hours in any continuous 24 hour period.

 

 

Background

 

A request has been received from the Connétable of St Brelade to change the current maximum stay period scheduled for St Brelade’s Church Car Park at the top of the Slip in St Brelade from the existing maximum seven days to a maximum 12 hours in a continuous period of 24 hours.

 

The current maximum stay period is attracting vehicles which are left for considerable periods of time thus removing the use of this facility from others who wish to visit St Brelade’s Church or the beach. The requested change is to enable the Parish to police the car park for the purpose it was intended, to allow visitors to the Parish Church and beach.

 

The Parish of St Brelade will still be responsible for maintenance and policing of the car park.

 

 

Discussion

 

Officers would support the change of maximum stay period in St Brelade’s Church Car Park at the top of the Slip to a maximum stay of 12 hours in any continuous 24 hour period. The policing and enforcement of this would be carried out solely by the Parish of St Brelade.

 

 

Recommendations

 

The Minister is recommended to approve the request from the Connétable of St Brelade and to instruct Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.
