Transfer of Education Officer budget to the Home Affairs Department.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister accepted the funding transfer of £46,610 from the Education Sport & Culture Department with effect from 01 April 2008 and the full year effect of £63,300 from 2009 (ECS Ministerial Decision MD – ESC – 2008 – 0025 refers).

Reason(s) for Decision:

To assist HMP La Moye to provide education to those individuals of compulsory school age who are either on remand or have been sentenced.

Resource Implications:

FTE has been provided by HM Prison within the Performance Improvement Plan which was requested and approved in 2007.

Action Required:

The Finance Director to request the Treasurer of the States to action this as a non-contentious transfer between departments in accordance with Financial Direction 3.6 (Variations to Heads of Expenditure).

HOME AFFAIRS DEPARTMENT

 

Transfer of Education Officer Budget from the Education, Sport & Culture Department to the Home Affairs Department 
 
 

  1. INTRODUCTION

 

The purpose of this report is to:- 

  • outline the background and circumstances of the transfer of the budget of an Education Officer post within Education, Sport & Culture (ESC) to the Home Affairs Department;

 

  • seek Ministerial approval to accept the funding from 01 April 2008 from ESC.

 
 

  1. BACKGROUND

 

  • In early 2007, following the release of the HMI Report, the Head of Evaluation and Standards from ESC worked with the Prison Governor regarding the then current level of education provision at the Prison for those individuals of compulsory school age (both on remand and sentenced) which had up until that point been met by teachers from Greenfields Centre and previously Les Chenes School.

 

  • It was agreed that a temporary secondment of a full time FTE for a period of 12 months from April 2007 would be given to the Prison to enable the introduction of a dedicated Education Department. Due to its success in the spring of 2008 this secondment was made permanent and the Assistant Director for Schools and Colleges took the decision to transfer the funding to the Home Affairs Department (equivalent to the post holders current salary level).
  • During the temporary secondment no budget was transferred and the seconded Assistant Head Teacher from Hautlieu continued as an employee of ESC. The Home Affairs Department provided ESC the difference in funding between the proposed supplementary allowance and the current salary of the post holder

 

  

3.   RECOMMENDATION 

It is recommended that the Minister agrees to the transfer of the pro-rated funding from 01 April 2008 in the amount of £46,610 and the full year effect funding of £63,300 from 01 January 2009.
