Sorel Loop Road, St. John: Jersey Kart and Motor Club: Permission for modification work

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

MODIFICATIONS TO SOREL LOOP ROAD BY JERSEY KART AND

 

MOTOR CLUB

 

Purpose of the report

 

To outline the proposed modifications to Sorel Loop Road by Jersey Kart and Motor Club to effect modifications to private and public land inside the loop road and extend the kart track.

 

 

Background

 

Jersey Kart and Motor Club received Planning Permission on 28 February 2016 to undertake modifications to private and public land inside of the DfI public carriageway known as Sorel Loop Road to extend the kart track. Jersey Kart and Motor Club has received permissions from the private and public landowners to effect the modifications.

 

The kart track modifications require two new interfaces with the public section of carriageway. The kart track inside of the public road will not be administered or maintained by DfI, and will not be accessible to the public on non-race days.

 

The two new interfaces with the public road require modifications to the public carriageway. Jersey Kart and Motor Club will also undertake amendments to the roadside kerb along the inside face of the road (which is not used by pedestrians) to increase safety during kart racing. Jersey Kart and Motor Club have designed the new kart track (and modifications to the public section of the road used) for racing in conjunction with the Motor Sports Association. DfI Highway Maintenance have approved the technical and maintenance details of the modifications (to public infrastructure) and agreed the extents of ongoing maintenance.

 

The main elements of the scheme are:

 

Two new interfaces with the public carriageway

Lowering of existing roadside kerbs

 

 

Quality Control

 

DfI Highway Maintenance Inspectors will periodically attend the site. The work on and immediately adjacent to the public highway will be undertaken by a DfI Highway Maintenance Approved Contractor.

 

 

Recommendations

 

The Minister is recommended to issue permission to Jersey Kart and Motor Club to undertake the modifications to the public highway infrastructure.

 

 

Reason for Decision

 

Jersey Kart and Motor Club have received Planning Permission. Jersey Kart and Motor Club are not a Statutory Undertaker, but a developer undertaking modifications to a public highway.
