States of Jersey Mapping Service: Business Partner: Digimap: Contract: 12 Month Extension

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister for Planning and Environment decided to approve the extension of the existing contract with Digimap for 12 months in order to provide the States of Jersey with a continued business partner mapping service until a new contract can be procured and awarded.

Reason(s) for Decision:

  1. The current contract expires on November 9th 2012 and the continuation of the business partner service is required until a new tender process can be completed.
  2. To allow the States of Jersey additional time to review the scope of the contract prior to going out for tender of a new contract to provide the States of Jersey with a business partner mapping service.

12 month extension to States of Jersey Mapping Business Partner Contract

 

1.                 Background

1.1.           The development of the digital map, its layers and the Jersey Land and property Index has enhanced the States ability to share map related information and improved the service delivery of a number of key business systems.

1.2.           The original appointment of a business partner (Digimap) in 2005 and the subsequent further tender process and contract awarded in 2007, has provided commercial users with robust mapping solutions and the States of Jersey with an income stream that had been ring-fenced for use in re-development and maintenance of the mapping products.

1.3.           The current contract with Digimap expired on 9th November 2012.

1.4.           A review of the current contract is underway and will inform an open tender process to award a new and revised contract. This process requires some additional work and so a 12 month extension to the current contract is required.

2.                 Performance to Date

2.1.           The business partner has matured and since the start of commercial sales in October 2005 Digimap have generated significant income to the States of Jersey, whilst also providing an excellent service to the current users. This has been achieved through a successful marketing strategy and comprehensive support arrangements to commercial users at no cost to the States of Jersey.

2.2.           Projections over the next year will see a further expansion of the user base and a predicted income stream of circa £135,000 per year to the States of Jersey.

2.3.           This income will enable the States to maintain and develop the mapping products to the benefit of both the public and private users and its loss would be detrimental to the project.

3.                 Advice and Consultation

3.1.           The States of Jersey Director for Strategic Procurement has offered advice and signed the exception form to comply with financial direction 5.1, which enables an extension of the contract for a period of 12 months. (appendix A)   

3.2.           The law office has offered advice on the extension of the contract and made the recommendation that the  12 month contract extension with Digimap is in acceptable form and should not result in material prejudice to the Minister and/or the States of Jersey.

3.3.           In commercial terms the contract is based upon the same terms and conditions as the current contract.

4.                 Recommendation

4.1.           It is recommended that the Minister approves and signs a 12 month extension to the existing business partner contract as it enables the continuation of this partnership until a revised contract can be fully scoped, tendered and awarded.
