Road Traffic (Saint Clement) (Amendment No. 18) (Jersey) Order 2007.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister made an Order entitled Road Traffic (Saint Clement) (Amendment No. 18)(Jersey) Order 2007.

Reason(s) for decision:

To implement parking restrictions in La Rue de Jambart, while further work is carried out to determine whether La Rue Hamel is in an appropriate condition to be adopted.

Action required:

  1. To send the hard copy of the Order to the Publications Editor at the States Greffe as soon as it has been signed.
  1. The Transport and Technical Services Department to establish what is required to be undertaken by the Developer, to bring La Rue Hamel up to an acceptable standard to allow the adoption to proceed.

Road Traffic (Saint Clement) (Amendment No 18) (Jersey) Order 2007

Purpose of the Report

To brief the Minister on the progress of the adoption of “La Rue Hamel” in the Parish of St Clement, and to seek his approval to enable the implementation of parking restrictions in La Rue Hamel, ahead of the adoption of the new road.

Background

In 2004 the then Environment and Public Services Committee entered into a Planning Obligation Agreement under the Island Planning (Jersey) Law, 1964, Article 8A, with the Developers of Field 203, the northwest part of field 204, and field 252, St Clemet. The agreement permitted the construction of 76 homes for the purpose of first time buyers on the land described above.

The agreement included the following clauses:

  Section 5.4 required the Developer to construct a new road to the reasonable satisfaction of the Public Services Committee.

  Section 5.5 states that on satisfactory completion of the road, the owners or Developer shall transfer the legal ownership of the new road to the Public or to the Parish of St Clement free of charge and free of all encumbrances. The legal fees incurred by the Public are to be borne by the Developer.

  Section 5.6 states that the Developer undertakes to provide the Highway Authority with a defect liability period of 12 months for the new road.

  Section 5.7.1 required the Developer to pay the Committee on commencement of the development the sum of £37,500 as a contribution to the costs of implementation of traffic calming measures along La Rue de Jambart.

The new road has now been completed, as has the development of the land for first time buyer houses and many of the houses are now occupied. Traffic calming measures have been progressed in La Rue de Jambart as far as possible, without adopting La Rue Hamel.

Discussion

The junction of La Rue de Jambart and La Grande Route de St Clement had been identified as a junction of poor standard, with a record of road traffic collisions. When the Development of the land described above was first proposed, the E&PSC identified that there was an opportunity to achieve an improvement to the road network. This could be achieved by providing a link road as part of the new development from Jambart Lane to La Grande Route de St Clement, and making the upper section of La Rue de Jambart one way south bound. Thus providing north bound vehicles on la Rue de Jambart a junction out onto La Grande Route de St Clement, constructed to modern standards.

The Department wrote to the Parish of St Clement asking whether the Parish wished to take on the ownership of the new road. The Parish declined to take on the ownership and administration of the new road, a Main Roads Classification Act is therefore required to be approved by The States of Jersey, so that the Minister for Transport and Technical Services can administer the new road.

The naming of new roads is defined in the law as the responsibility of a Parish Assembly. The Department wrote to the Parish requesting a parish assembly be held and a name selected. The Parish duly wrote back having approved at an Assembly the name of La Rue Hamel.

At various stages of the development of plans for the new housing development, the existing residents of the area as well as the Parish, were consulted. The results of this consultation have been included in the proposals now nearing completion.

In response to concerns by existing residents it was agreed that cars exiting the new development would not be allowed to access La Rue de Jambart directly from the new road. This requires the western most section of the new road for a distance of 50m from La Rue de Jambart to be made one way east bound, and is intended to reduce the likelihood of residents of the new housing development using La Rue de Jambart.

An early proposal for vertical traffic calming in La Rue de Jambart was rejected by the Parish and residents, but a later scheme which includes horizontal calming features, and footpath widening and extensions was agreed to.

The works in La Rue de Jambart are now at a stage where the new road needs to be opened to traffic, the upper section of La Rue de Jambart needs to be made one way south bound, and various parking restrictions need to be introduced on La Rue de Jambart.

However, the adoption of La Rue Hamel cannot proceed for the time being, as TTS Drainage Section has concerns with some of the aspects of the drains, which are located within the area of land to be transferred to Public ownership. As La rue Hamel can not yet be opened to through traffic, the one way system can not yet be implemented. The parking restrictions can, however, go ahead.

Conclusion

It cannot be established at present as to whether the drainage under the new road (La Rue Hamel) has been constructed to a reasonably acceptable standard. The transfer of ownership of the road cannot therefore take place. The Traffic Calming works in La Rue de Jambart have progressed to a point where the required amendments to the Road Traffic (St Clement) (Jersey) Order 1987 should be made, so that parking restrictions can be enforced.

Recommendation:-

The Minister for Transport and Technical Services is recommended to:

Sign and seal the Road Traffic (Saint Clement) (Amendment No. 18)(Jersey) Order 2007, so that parking restrictions can be implemented in La Rue de Jambart, pending further investigation by the Transport and Technical Services Department as to the suitability of La Rue Hamel for adoption.

Reason(s) for Decisions

To enable parking restrictions to be implemented in La Rue de Jambart, while further work is carried out to determine whether La Rue Hamel is in an appropriate condition to be adopted.

Action Required

  1. Road Traffic (Saint Clement) (Amendment No. 18)(Jersey) Order 2007 to be signed and sealed by the Minster for Transport and Technical Services.
  1. The Transport and Technical Services Department drainage section to establish what is required by the Developer, to bring La Rue Hamel up to an acceptable standard to allow the adoption to proceed.
