'La Profonde Rue' Steps, La Rue du Crocquet, St Brelade: Removal from List of Sites of Special Interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that ‘La Profonde Rue’ Steps (off High Street), La Rue du Crocquet, St Brelade be removed from the List of Sites of Special Interest

Reason(s) for Decision:

  1. The loss of historic integrity of ‘La Profonde Rue’ Steps (off High Street), La Rue du Crocquet, St Brelade, as set out in the report and relative to the published criteria for selection, does not justify their inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and;
  2. it accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.

Legal and Resource Implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attached to the building or place.

Purpose of the Report

The purpose of this report is for the Minister for Planning and Environment to consider the status of ‘La Profonde Rue’ Steps (off High Street), La Rue du Crocquet, St Brelade on the List of Sites of Special Interest.

Background and discussion

A concerned member of the public alerted the Minister to unauthorised works to these steps, which were believed to be of some historic significance, earlier on this year as a result of which the Minister requested that they be provisionally added to the List of Sites of Special Interest. Notice was duly served on the owner of the building the owner providing opportunity for representations to be received. No formal objection to the proposed designation have been received.

The steps have been assessed by Jersey Heritage and its reports, including the views of the Ministerial Registration and Listing Advisory Group, are attached.

Recommendation

On the basis of the above, Jersey Heritage recommend that the steps have lost their historic integrity and accordingly do not merit inclusion on the List of Sites of Special Interest, in accordance with criteria for designation.

Reason(s) for Decision

The retention of ‘La Profonde Rue’ Steps (off High Street), La Rue du Crocquet, St Brelade as a Site of Special Interest is not in accordance with the criteria for assessment and designation.
