A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION: The Minister for Home Affairs acknowledged that The Police Act 1997 (Criminal Records and Registration) (Jersey) (Amendment No.2) Regulations 2012 had been made on 23rd October 2012 and came into force on 19th November 2012.

 

The Regulations amend regulation 8 of the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010 to substitute reference to “National Policing Improvement Agency” for “Secretary of State”.

 

The Minister confirmed his agreement to this change and that the change should apply to Jersey.

 

RESOURCE IMPLICATIONS: None

ACTION REQUIRED: The Minister’s Private Secretary to share the Minister’s decision with Law Officers prior to registration in the Royal Court on the motion of the Attorney General (or a Crown Advocate on his behalf).

Amendment to the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2012

The Police Act 1997 (Criminal Records and Registration) (Jersey) (Amendment No.2) Regulations 2012 were made on 23rd October 2012 and came into force on 19th November 2012.

These Regulations amend the Police Act 1997 (Criminal Records and Registration) (Jersey) Regulations 2010.

The 2010 Regulations provided for applications made in Jersey for criminal record certificates and enhanced criminal record certificates under Part 5 of the Police Act 1997 of the UK.

The effect of the amendment in 2012 was merely to replace the reference to the National Policing Improvement Agency (“NPIA”) with a reference to the Secretary of State. 

The NPIA was being phased out and the Home Office had taken over the function of running the Police National Computer. The Jersey Regulations required amendment simply to reflect this change that was happening in the UK. 

The regulations are only now being registered in the Royal Court and it is therefore requested that the Minister confirm his agreement to this change and that the change should apply to Jersey.

The Minister should note that a second set of Regulations will also be registered in the Royal Court. The Minister has previously approved this change in MD-HA-2019-0089.

The Attorney General (or a Crown Advocate on his behalf) will move for their registration by the Royal Court in accordance with Article 9 of The Police Act 1997 (Criminal Records) (Jersey) Order 2010.
