Road Traffic (St. Helier) (Jersey) Order 1996 - Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Road Traffic (St Helier) (Amendment No 25) (Jersey) Order 2012 to become effective on 01 May 2012.

 

Reason(s) for Decision: To increase the cost of permit fees in Residents’ Parking Schemes in the Parish of St Helier by 10% at the request of the Connétable of St Helier.

ROAD TRAFFIC (ST HELIER) (JERSEY) ORDER 1996 - AMENDMENT

 

 

Purpose of the Report

 

To amend the Road Traffic (St Helier) (Jersey) Order 1996

 

 

Background

 

The cost of a permit for parking in any of the Parish of St Helier’s Residents’ Parking Schemes has not changed since the introduction of each scheme, the first of which commenced over ten years ago. Whilst the income derived from fees used to cover the costs of administration and policing, the schemes now operate at a financial loss.

 

 

Discussion

 

Article 32 of the Road Traffic (St Helier) (Jersey) Order 1996 specifies the fees that must be charged for Residents’ Parking Permits. The fees can therefore only be changed by a Ministerial Decision to amend the Parish Order.

 

The Connétable of St Helier has requested a ten per cent (10%) increase in the price of Residents’ Parking Permits, to be effective from 01 May 2012.

 

The proposed increases are:

 

  • The resident’s parking permits for the Cheapside Zone, St Mark’s Zone and St Thomas’ Zone shall be increased from £200 to £220 per annum;

 

  • The resident’s parking permit in relation to the Richmond Road Zone shall be increased from £100 to £110 per annum;

 

  • The business parking permit in relation to any one zone shall be increased from £150 to £165 per annum.

 

 

Recommendation

 

The Minister is recommended to make the Road Traffic (St Helier) (Amendment No 25) (Jersey) Order 2012, to become effective on 01 May 2012.

 

 

Reason for decision

 

To increase the cost of permit fees in Residents’ Parking Schemes in the Parish of St Helier by 10%.
