Road Traffic (St. Lawrence) (Jersey) Order 1990: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST LAWRENCE) (JERSEY) ORDER 1990

 

 

Purpose of the Report

 

To amend the Road Traffic (St Lawrence) (Jersey) Order 1990 introducing new prohibition of waiting restrictions to the Order.

 

 

Background

 

The Connétable of St Lawrence has requested to prohibit waiting in four locations across the Parish to improve road safety and traffic flow in those areas.

 

Furthermore the Connétable has requested that a maximum waiting period is applied to Mont Cambrai to discourage long term parking, which has become an issue in that location.

Amendment to Schedule 3 “Prohibition of Waiting” of the Road Traffic (St Lawrence) (Jersey) Order 1990

 

Mont Cambrai

West and North Side from its junction with La Rue de Haut to a point 11 yards east of the entrance to La Vallette

 

La Rue de Haut

Both sides from a point 50 yards east of its junction with Mont Cambrai to a point 80 yards west of its junction with Mont Cambrai

 

Le Mont Cochon

West Side (From a point 10 yards south of the junction with La Ruelle St Claire to a point 25 yards further south)

 

La Route de St Aubin

South side (from a point 90 yards west of La Rue de Galet to a point 105 yards east of La Rue de Galet) 

 

Amendment to Schedule 7 “Duration of Parking on Certain Roads”

 

Mont Cambrai

North Side, from a point 11 yards east of the entrance with La Vallette to a point 45 yards further east.

 

 

 

 

Recommendation

 

The Minister is requested to approve the request.

To amend the Road Traffic (St Lawrence) (Jersey) Order 1990 to amend Schedule 3 “Prohibition of Waiting” and to amend Schedule 7 “Duration of Parking on Certain Roads”.
