Health and Safety at Work Appeal Tribunal Members: Remuneration

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report Title: Remuneration of Health and Safety at Work Appeal Tribunal members

Decision(s):

The Minister for Social Security agreed to the recommended rates of remuneration for the Health and Safety Appeal Tribunal Members. Regulation 6 of the Health and Safety at Work (Appeal Tribunal) (Jersey) Regulations, 1989 provides for Tribunal members to be paid such salaries, allowances and expenses.

Reason for Decision(s):

The Health and Safety Appeal Tribunal sits to hear appeals against Prohibition and Improvement Notices issued by Health and Safety Inspectors, and to determine appeals against decisions made by the Minister for Social Security on matters relating to licences issued under Regulations made under the Health and Safety at Work (Jersey) Law 1989. To provide consistency with remuneration provided to other Social Security Tribunals and recognise all members who give their time in the event of the Tribunal being convened to hear an appeal, the Minister is increasing the remuneration rates in line with those of other Tribunals.

Resource Implications: The cost to constitute a Tribunal for one day would be dependent on the constitution outlined in paragraph 6 of the written report: a. £1400 (Chair or Deputy Chair at daily rate £800 + 2 members £300 each); or b. £1900 (Chair and Deputy Chair daily rate £800 +1 member £300); or  c. £1100 Chair or Deputy Chair daily rate £800 + 1 member £300)  Additionally, The Chair would be paid an annual retainer of £350 and the Deputy Chair would be paid an annual retainer of £250.  There have only been 3 appeals heard by the Tribunal since 1989; 2 in 2007 and 1 in 2013. All were heard within half a day. The daily costs plus the annual retainer would be paid from existing budgets.
