Decision: The appeal is dismissed and a variation of the decision has been made. The Minister hereby grants permission to develop the land under Article 116 of the Planning and Building (Jersey) Law 2002 in respect of revised plans: change of use of previously permitted Restaurant Use (use Class B(a)) to mixed use comprising a Restaurant with associated ancillary Public House and Entertainment Uses’ to be carried out at 14-16 Weighbridge Place, Weighbridge Street, St Helier. This permission is granted subject to compliance with the following conditions and approved plan(s): - This permission solely relates to the revisions described above.
Notwithstanding details on the approved drawings, prior to the introduction of the new double doors, joinery details in horizontal and vertical section, scaled no smaller than half full size, shall be submitted to and approved in writing by the Minister for Planning and Environment. The new doors shall then be fully installed prior to first occupation of any element of the application site, and thereafter retained in perpetuity. Reason: These details are not included in the application and are required to be submitted and agreed by the Department of the Environment to ensure that special regard is paid to the interests of protecting the architectural and historical interest, character and integrity of the building or place, in accordance with Policies SP4 and HE1 of the Adopted Island Plan 2011 (Revised 2014). 2. Details of the positioning of external CCTV cameras shall be submitted to and agreed in writing with the Department of the Environment, prior to first use. The details shall be implemented and thereafter permanently maintained unless otherwise agreed in writing. Reason: To protect the amenities of occupiers of neighbouring properties and to safeguard the character of the area, in accordance with Policy GD1 of the Adopted Island Plan 2011 (Revised 2014). 3. The use hereby permitted shall be the mixed use defined in the Applicant’s letter dated 19 February 2015 and this permission shall not permit any material change from that use. Reason: For the avoidance of doubt. 4. The approved scheme of acoustic insulation shall be fully implemented prior to the commencement of the use hereby permitted and shall be satisfactorily maintained thereafter. Reason: To protect the amenities of neighbouring properties and occupiers in accordance with Policy GD1 of the Adopted Island Plan 2001 (Revised 2014).
