The Beach House, Gorey Pier, St. Martin: Amendment to the List of Sites of Special Interest.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister for Planning and Environment determined that;

· The Beach House Brasserie (formerly 15 Havre du Mont Orgueil), Gorey Pier, St Martin shall be removed from the List of Sites of Special Interest and maintained on the Register of Buildings and Sites of Architectural, Archaeological and Historical importance as a Building of Local Interest.

Reason(s) for decision:

The Beach House Brasserie (formerly 15 Havre du Mont Orgueil), Gorey Pier, St Martin does not have sufficient special interest to meet the published criteria for Listing as a Site of Special Interest, but maintains sufficient architectural and historical merit to meet the criteria for restration as a Building of Local Interest.

Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey

Amendment to the List of Sites of Special Interest: The Beach House Brasserie (formerly 15 Havre du Mont Orgueil), Gorey Pier, St Martin.

Purpose of the Report

The purpose of this report is for the Minister to amend the list of Sites of Special Interest, having regard to the States strategic objective ‘to protect the best of the Island’s architectural heritage’ and a key objective of the Island Plan 2002 to protect and promote Jersey’s built, cultural and archaeological heritage. The report addresses a decision made in the 1970s to designate the building as a Site of Special Interest and a subsequent decision of the Jersey Building Heritage Sub-Committee to re-grade the building as a Building of Local Interest.

Background

The Minister was presented a report on 16 March 2007 which addressed the de-listing of a number of properties which had been designated in the 1970s and later identified by the Jersey Building Heritage Sub-Committee for de-designation during its review of the Register (1998-2002): the de-listing of these properties had been deferred due to resourse issues. The Minister determined that de-designation should commence in relation to the properties named on that report. Due to a misunderstanding of the addresses (there are two properties referred to as no. 15 Gorey Pier) The Beach House Brasserie (formerly 15 Havre du Mont Orgueil), Gorey Pier, St Martin was omitted from the list of properties named on the report approved by the Minister on 16 March.

Discussion

The Beach House Brasserie (formerly 15 Havre du Mont Orgueil), Gorey Pier, St Martin was identified by the Jersey Building Heritage Sub-Committee as having insufficient special interest to meet the current SSI listing criteria adopted in 1998, however that due to the positive contribution its external character makes to Gorey Pier, it merits retention on the Historic Buildings Register as a Building of Local Interest.

Recommendation

It is recommended that the Minister for Planning and Environment resolves to remove The Beach House Brasserie (formerly 15 Havre du Mont Orgueil), Gorey Pier, St Martin from the List of Sites of Special Interest and to maintain it on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest.

Reason(s) for Decision

The building does not have sufficient special interest to meet the published criteria for Listing as a Site of Special Interest.

The Registration of The Beach House Brasserie (formerly 15 Havre du Mont Orgueil), Gorey Pier, St Martin is in accordance with Interim Policy HB1 which states ‘Historic buildings which contribute positively to the distinctive character or appearance of Jersey’s built-up areas or countryside, particularly where they are of ‘group value’, will be identified and included in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey.’
