Changes to certain protection measures against foot-and-mouth disease in Great Britain.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Assistant Minister decided to request the Law Draftsman to prepare an Order which would permit only the import of animal products dispatched from Great Britain in compliance with the EU Decisions 2007/663 and 2007/ 664 adopted on 12/10/07

Reason(s) for Decision:

Continue and update protection measures in accordance with EU Decision. These latest EU decisions have the effect of allowing exports of meat and meat products from Scotland and Wales and from various local authority areas of England that are not within the Foot and Mouth control zone.

Changes to certain protection measures against foot-and-mouth disease in Great Britain

Purpose of the Report

It is proposed that the Planning and Environment Minister makes an Order implementing the European Union Commission Decision 2007/554 of 9 August 2007

as amended by EU Decisions 2007/663 and 2007/664 adopted on 12 October 2007 concerning certain protection measures against foot-and-mouth disease in the United Kingdom, as attached. This Order would revoke The Diseases of Animals (Foot and Mouth – Restrictions No 5) (Jersey) Order 2007 and update the legal backing for controls on the importation of meat and other animal products from England, Scotland and Wales.

Background

The EU Decision means that only meat and animal products which conform to EU Decision 2007/554 as amended can be dispatched from Great Britain to EU Member States providing they meet the conditions laid down in the amended Decision.

The restrictions are designed to control the risk of the spread of Foot and Mouth Disease and apply to Jersey.

This Order would mean that the products listed by the EU cannot be imported to the Island, from England, Scotland or Wales without certificates issued to demonstrate compliance with EU Decision 2007/554 as amended.

These latest EU decisions have the effect of allowing exports of meat and meat products from Scotland and Wales and from various local authority areas of England that are not within the Foot and Mouth control zone

Discussion

Advice received from the Attorney General on 9 August 2007 confirms that this action is appropriate to Jersey’s status under the terms of Protocol 3 to the Treaty of Accession of the United Kingdom to the European Community

Recommendation

Implementation of the amended Decision by a new Order is recommended
