Road Traffic (St. Clement) (Jersey) Order 1987: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

GROWTH HOUSING AND ENVIRONMENT

 

ROAD TRAFFIC (ST CLEMENT) (JERSEY) ORDER 1987 - AMENDMENT

 

 

Purpose of the Report

 

To amend the Road Traffic (St Clement) (Jersey) Order 1987 to introduce a permanent closure of La Rue du Maupertuis to through traffic and to introduce new prohibition of waiting restrictions.

 

 

Background

 

In the interests of road safety, and to support sustainable transport initiatives, two amendments to parking and traffic restrictions across the Parish are to be made on roads administered by both GHE and the Parish of St Clement.

 

 

Schedule 2 ‘Prohibition of Waiting’

 

La Rue de Samarès:

  • Issues have arisen due to long term parking close to private accesses. The parking of private vehicles is restricting visibility for vehicles leaving those residences creating a highway safety issue. The Connétable wishes to prohibit waiting in the vicinity of this access to ensure that any parking on the road is done in a safe manner.

 

 

Schedule 4 – ‘Roads Closed to Through Traffic’

 

La Rue du Maupertuis

  • Following a successful trial of this restriction, where bollards have been used to prevent through traffic, the Parish and GHE officers are in full support of this measure becoming permanent due to benefits in providing a safe route to school for sustainable modes of transport.

From a point 23 yards north of its junction with La Rue de la Croix for a distance of 20 yards in a northerly direction.

 

Schedule 4 – ‘Roads Closed to Through Traffic’

 

La Rue du Maupertuis:    

At a point 290 yards west of La Rue du Samares

Duration: At all times.

 

 

Recommendation

 

The Minister is requested to approve the request.

To amend the Road Traffic (St Clement) (Jersey) Order 1987 to amend Schedules 2 and 4.
