Delegated Powers in respect of tags for fishing pots.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the attached list of delegations and authorisations which supersedes the list agreed on 7 February 2007 (MD-E-2007-0037).

Reason(s) for decision:

The Sea Fisheries (Miscellaneous Provisions)(Amendment No. 4)(Jersey) Regulations 2007 introduce a requirement that pots used to catch certain types of shellfish by commercial fishermen need to have identifying tags attached to them. The regulations allow the Minister to decide the type of tag and the year/years for which tags are valid and to make exemptions from the need for pot tags in special circumstances. The Minister is also able to issue “lost pot tags” and to set the conditions to be attached to any exemption permit.

In order to manage this scheme on a day to day basis it is necessary for the Minister to make the new delegations and authorisations on the amended list.

Purpose of the Report

To ensure efficient administration of the Shellfish pot tagging scheme.

Background

The Sea Fisheries (Miscellaneous Provisions) (Amendment No.4) (Jersey) Regulations 2007 became effective on 6th February 2007. This amendment effectively put in place a pot tagging scheme for shellfish pots for all commercial fishing vessels operating in the Jersey territorial sea. The scheme had already been in operation as a licence condition for Jersey registered fishing vessels since late in 2005.

Pot tags are issued on an annual basis and the regulations make provision for the type of tag, exemptions for tags and conditions attached to such exemptions and the issue of “lost pot tags”.

Discussion

Regulation 8 makes provision for the Minister to grant permits for exemptions and to approve the type of tags. The Minister is also empowered to authorise persons to issue pot tags and lost pot tags. In excess of 150 fishermen apply for pot tags each year and exemptions are required on a regular basis, typically when fishermen change boats part way through the year. Bad weather and fishing interaction also cause the loss of pots and fishermen need replacement tags to be issued relatively quickly.

It would be impractical for the Minister to deal with all aspects of the pot tagging scheme on a day to day basis and for this reason seven sets of delegations/authorisations have been included on the attached list of delegated powers. These delegations/authorisations will allow Fishery Officers and administrative staff to administer the pot tagging scheme in exactly the same way as it has been operated for the last 17 months.

Recommendation

It is recommended that the attached list of delegated powers and authorisations is approved.
