Road Racing (Motor Vehicle Rally) (Jersey) Order 2008

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES

 

THE JERSEY MOTOR CYCLE AND LIGHT CAR CLUB’S APPLICATION FOR A SHORT CAR RALLY  2008

 

 

 

1.0 Purpose of the Report 

 

To obtain Ministerial Decision regarding approval of the Jersey Motor Cycle and Light Car Club’s short rally application.

 

 

2.0 Background

 

The Promoter (The Jersey Motor Cycle and Light Car Club) has submitted details of its proposed route stages for a short rally to take place on Saturday 12 July (see attached Schedule). The event is enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Motor Vehicle Races (Jersey) Law 1946”.

 

The Promoter has consulted with the Connétable of St. Ouen and other stakeholders directly affected by the road closures.  They have also supplied proof of Public Liability Insurance.

 

 

Discussion

 

The proposed ‘short rally’ (2 stages) is to replace a quarry rally which had to be cancelled earlier this year. Nevertheless should the event prove successful the Promoter intends to establish the short rally as an annual event; based on a new course each year (different to the October rally).

 

 

Recommendation

 

The Minister is recommended to approve the Road Racing (Motor Vehicle Rally) (Jersey) Order 2008 as prepared.

 

Action Required

 

Advise the Greffier that the Order has been made and forward the Decision Summary and Report, together with the signed and sealed Order to the Publications Editor at the States Greffe.

A course comprising the following public roads and portions of public roads in the Parish of St. Ouen:–

La Route des Havres from Les Havres Slipway to its junction with Le Mont du Vallet; thence along Le Mont du Vallet to its junction with La Route du Ouest; thence along La Route du Ouest and La Rue de la Mare to a point 50 metres south of the latter’s junction with La Rue de la Devise.

Period of closing – Saturday 12th July 2008 between 8.30 a.m. and 12.30 p.m.

A course comprising the following public roads and portions of public roads in the Parish of St. Ouen:–
