A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for decision:

The additional facilities to a tight tank was unnecessary in this instance given that the existing septic tank is relatively new, working satisfactorily and of sufficient volume to cope with the potential additional loading. In addition, two associated environmental benefits were considered to be considerable in comparison to the relatively small increase in loading to the existing drainage system.

Policy NR2 – Foul Sewerage Facilities

New development proposals that rely on septic tanks, soakaways or private sewage treatment plants as a means of waste disposal will not normally be permitted.

Comments on Case

The dwelling is not served by the foul sewer (it is not available) and therefore in accordance with Policy NR2 any new development that relies on the existing septic tank and soakaway is contrary to Policy NR2. In these circumstances, the Department can agree new development that is connected to a tight tank given that the waste is disposed of in a controlled manner. Therefore the approved additional bedroom and bathroom must be connected to a tight tank. It was understood at the time of approval that it was likely that the agent would request the reconsideration of this condition due to the size and serviceability of the existing septic tank.

Transport and Technical Services (Drainage) have stated that the drainage proposals for the extended dwelling are satisfactory and the Senior Building Control Officer has stated that the system “appears to be suitable for the proposals”.

In addition the agent states that there are two environmental benefits, namely that the use of the existing system negates the need for tanker movements (to collect the waste) and the excavation associated with the installation of the tank tight. These benefits are not disputed.

In conclusion, the circumstances of this site mean that the development may be adequately served by the existing septic tank and soakaway at this time. However, this is contrary to Policy NR2, and the existing practice of the Department, that are designed to prevent the pollution of the land and the aquatic environment particularly if the system were not to be maintained in the future.
