Budget transfer from Commercial Recycling to La Collette Waste Site

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved the transfer of £1,400,000 from the Commercial Recycling Capital Head of Expenditure (Q00MF17013) to the La Collette Waste Site Development Capital Head of Expenditure (Q00MF18020) in order to consolidate the capital spend at La Collette under one head of expenditure.

Reason(s) for Decision:

Article 18(1)(c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

 

A decision (MD-T-2018-0037) was signed by the Minister for Infrastructure on 14th May 2018.

Resource Implications:

The Commercial Recycling Capital Head of Expenditure (Q00MF17013) to decrease by £1,400,000 and the La Collette Waste Site Development capital head of expenditure (Q00MF14035) to increase by £1,400,000.

 

This decision does not change the total amount of expenditure approved by the States for 2017-2019 in the Medium Term Financial Plan.

Budget transfer from Commercial Recycling Capital Head of Expenditure to La Collette Waste Site Development Capital Head of Expenditure

 

  1. Purpose of Report

To enable the Minister to approve the transfer of £1,400,000 from the Commercial Recycling Capital Head of Expenditure (Q00MF17013) to the La Collette Waste Site Development Capital Head of Expenditure (Q00MF18020) in order to consolidate the capital spend at La Collette under one head of expenditure.

 

  1. Background

The 2017 Budget allocated £1.4 million to the Commercial Recycling Capital Head of Expenditure to construct a new commercial recycling centre at La Collette on the site next to the Energy from Waste Plant that became available as a result of the disposal of the legacy asbestos waste. It was acknowledged at the time that the project would require more than the £1.4 million, and would be topped up in the 2018 capital programme.

 

During 2017 it was decided that the capital works at La Collette would be consolidated under the newly created La Collette Waste Site Development and that the £1.4 million allocated to the new Commercial Recycling Centre would be transferred to the new head of expenditure. The 2018 Budget reflects this, stating ‘In 2018 funding is required for construction of the new Commercial Recycling Centre (in addition to the funding allocated in the 2017 budget), capital works associated with Waste Cells and other associated works at the La Collette site.’

 

3. Recommendation

The Minister is recommended to approve the transfer of £1,400,000 from the Commercial Recycling Capital Head of Expenditure (Q00MF17013) to the La Collette Waste Site Development Capital Head of Expenditure (Q00MF18020) in order to consolidate the capital spend at La Collette under one head of expenditure.

 

4.   Reason for Decision
