The Cottage, Columbus Street, St. Helier: Cessation and transfer of ownership rights

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Exempt 3.2.1.(a)(x)

Subject: Cessation and transfer of ownership rights at “The Cottage” Columbus Street.

Decision(s):

 

That the Minister agreed to:

  1. the cession and transfer to Jeremy Charles Corbel as owner of “The Cottage” of all and such rights that the Public may have in the common ownership of the Pathway as owner of various properties forming part of the site of Vincent Court with the associated loss of liability and financial responsibility;
  2. the rectification of all boundaries of Vincent Court and St. Simons Court towards “The Pathway” and The Cottage; and
  3. the grant to the Public of all necessary access rights and service rights for Vincent Court, subject to the Vendors meeting all the reasonable costs and fees.

 

Requested that the Treasury and Resources Minister approve the transaction under Standing Order 168(2) (a) and authorise the Greffier of the States and the Attorney General to pass the necessary contract on behalf of the Public before the Royal Court. 

Reason(s) for Decision:

To approve the cessation and transfer of these ownership rights in accordance with Standing Order 168(2) (a)

Resource Implications:

The Public removes a potential future financial liability and the vendor will pay the Public’s costs.

 

Action required:

 

The Treasury and Resources Minister to approve the transaction under Standing Order 168(2) (a) and the Attorney General to prepare and pass the necessary contracts on behalf of the Public.
