Sewage Treatment Works, Bellozanne: Design and Build Contract: Award

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Award of Main Design & Build Contract for the New Sewage Treatment Works Project

 

Decision(s):

 

The Minister awarded the main Design & Build contract for the new Sewage Treatment Works project to North Midland Construction PLC under a Framework Agreement in the sum of £56,289,243.26, and confirmed the termination of the current Framework Agreement with Doosan Enpure Limited.

 

Reason(s) for Decision:

 

North Midland Construction PLC has submitted the most economically advantageous Civil Works tender, and have demonstrated during the Early Award Phase that integrating the Mechanical, Electrical, Instrumentation, Control and Automation (MEICA) Works packages into their scope provides a more effective, and economical delivery mechanism, than awarding a separate MEICA Works package contract to Doosan Enpure Limited.

 

North Midland Construction PLC are experienced and fully capable of delivering the new STW under a single contract, and  have confirmed that they are able to take on the performance guarantees that will be required on completion of the project.

 

DfI’s legal consultants, Eversheds, have confirmed that there are no financial or contractual implications of terminating the DEL Framework.

 

Sufficient Funds are available in Capital Vote Q00BT14022 Liquid Waste to enable Phase 1A of the new STW construction to commence.

 

Resource Implications:

 

Sufficient Funds are available in Capital Vote Q00BT14022 Liquid Waste to enable Phase 1A of the new STW construction to commence. Upgrades to the PST’s to control any potential odour emissions will commence on receipt of the additional funding from the Treasury.  Phase 1B and 1C will commence on completion of Phase 1A in 2020, and when additional funding for these Phases is in place.

 

Action required:

 

Chief Officer of DfI to award the construction contract for the new sewage treatment works at Bellozanne to North Midland Construction PLC and to terminate the existing Framework Agreement with Doosan Enpure Limited.
