Harbour Master and Airport Director: Swearing in of

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the swearing in of Mr J D Bannister, Group Chief Executive Jersey Harbours and Jersey Airport, as Harbour Master and Airport Director.

 

Reason(s) for Decision:  

 

Under the Harbours (Administration) (Jersey) Law 1961, the Harbour Master is responsible for ‘the administration of harbours and territorial waters; and such other matters as the Minister entrusts to the Harbour Master for the carrying into effect of any legislation that is in force from time to time relating to shipping and sea navigation’. The Harbour Master ‘shall, on or as soon as practicable after becoming Harbour Master, take oath before the Royal Court to well and faithfully discharge his or her duties as Harbour Master’.

 

Under the Aerodromes (Administration) (Jersey) Law 1952, the Airport Director is responsible ‘to the Minister for the policing, administration and management of Jersey Airport’. The Airport Director ‘shall, on or as soon as practicable after becoming Airport Director, take oath before the Royal Court to well and faithfully discharge his or her duties as Airport Director’.

 

The Group Chief Executive is responsible for the two States Trading Operations. The Public Finances (Transitional Provisions – States Trading Operations) (Jersey) Regulations 2005 define Jersey Airport as being responsible for ‘the administration, management, operation, financing, development and maintenance of Jersey Airport, its associated facilities and the Channel Island Control Zone’ and Jersey Harbours being responsible for ‘the administration, management, operation, financing, development and maintenance of the harbours of Jersey and their associated facilities’.

 

 

The appointment of the Group Chief Executive and Accounting Officer has enabled the integration of the two Trading Operations and organisation restructure. It is appropriate that the Accounting Officer holds the offices of Airport Director and Harbour Master as he is personally accountable for the proper financial management of resources and for the implementation of policy with due regard to value for money.

 

Once appointments to new Executive Roles have been confirmed, where necessary and appropriate, officers will be sworn in to Act as Airport Director / Harbour Master.
