Planning and Environment Department: Financial Review: Appointment of Consultants

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

To appoint BDO Alto Ltd to advise the Planning and Environment Department on its proposed CSR strategy for the forthcoming three year period (2011 – 2013) to commence in October 2010 and be concluded by the end of 2010The Minister, having been re-elected to the position, decided to renew the existing Agreement on the delegation of his statutory powers (R.120/2008)The Minister decided to Approve the planning application

 

 

Reason(s) for Decision: The decision to approve was given for the following reason: Permission has been granted having taken into account the relevant policies of the approved Island Plan, together with other relevant policies and all other material considerations, including the consultations and representations received.

 

The States of Jersey is facing a significant deficit in public finances from 2010 onwards which necessitates the need for a comprehensive review of States spending, the activities it carries out and a sustainable view of public services in the period 2011 to 2013. Investigation of the buisness of the Planning and Environment department would help to ensure that appropriate and achievable contributions are being made to these savings and following a selection process BDO Alto Ltd are considered to be best placed to help in this regard. To ensure that decisions are made at the appropriate level in the Ministry and Department to ensure the efficient administration of the Minister’s duties and responsibilities

Action required: Notify Agent, Applicant and all other interested parties and issue Planning Permit.
