Road Traffic (St. Lawrence) (Jersey) Order 1990 - amendments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES.

 

REQUEST FROM THE PARISH OF ST LAWRENCE FOR AN AMENDMENT TO THE ROAD TRAFFIC (SAINT LAWRENCE) (JERSEY) ORDER 1990

 

 

 

Purpose of the Report

 

To amend the Road Traffic (St Lawrence) (Jersey) Order 1990

 

 

Background

 

On 14 May 2008 the Minister for Transport and Technical Services considered requests by the Connétable of St Lawrence to amend the above Order as follows:-

 

1.      Reduce the number of 12 hours in any 24 hours parking spaces on the section of  La Route de St Aubin between St Matthews Church and “Magnolia Gardens”.

 

2.      Reduce the number of parking spaces near “Walkers Newsagents” on La Route de St Aubin and introduce a 20 minute disc parking restriction.

 

3.      Replace the section of 20 minute paycard parking on the west side of Le Chemin des Moulins with 20 minute disc parking.

 

 

Discussion

 

The Minister agreed to reduce the number of 12 hours in any continuous period of 24 hours parking spaces on the south side of La Route de St Aubin between St Matthews Church and “Magnolia Gardens”, but rejected the requests to introduce 20 minute disc parking near “Walkers” Newsagent on La Route de St Aubin, and to replace the 20 minute paycard parking on Le Chemin des Moulins with 20 minute disc parking.

 

At a subsequent meeting on site between the Minister, the Connétable of St Lawrence and  an Officer of TTS it was agreed to amend the original requests and instead to introduce 20 minute paycard parking near “Walkers” Newsagent, and to replace the 20 minute paycard parking on Le Chemin des Moulins with 1 hour paycard parking.

 

 

Recommendation

 

The Minister is recommended to approve the amended requests, together with the request to remove a section of 12 hours in any continuous period of 24 hours on the south side of La Route de St Aubin between St Matthews Church and Magnolia Gardens.

  1. To reduce the number of spaces available in the current 12 hours in any continuous period of 24 hours parking on La Route de St Aubin between St Matthews Church and “Magnolia Gardens”.

 

  1. To reduce the current parking spaces on La Route de St Aubin near “Walkers” Newsagent and introduce 20 minute paycard parking.

 

  1. To replace the current 20 minute paycard parking on Le Chemin des Moulins with 1 hour paycard parking.

             

 

Action Required

 

The Minister to request Officers to instruct the Law Draftsman to prepare an Amendment to the Order for subsequent submission to the Minister.
