Jersey Teachers' Superannuation Fund Management Board Members: Recommendation to the Chief Minister

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister recommended to the Chief Minister two nominees for reappointment to the JTSF Management Board.

 

Reason(s) for Decision:

 

Under the Teachers’ Superannuation (Administration) (Jersey) Order 2007 Article 3 – Appointment of members of Management Board, the Chief Minister shall appoint to be members of the Management Board:

 

6 Employer representatives of whom –

 

  • 2 shall be persons recommended by the Minister for Treasury and Exchequer;
  • 2 shall be persons recommended by the Minister for Education;
  • 2 shall be any persons that the Chief Minister thinks fit; and

 

6 Member representatives, who shall have been selected in the manner that the Chief Minister shall agree with the associations that appear to the Minister for Education to represent the interests of teachers.

 

Members of the Management Board shall hold office for 3 years and shall be eligible for re-appointment. The Chief Minister may at any time remove from office any member of the Management Board appointed by him or her under this Article.

 

The Treasury Minister recommended the reappointment of the following 2 nominees to the Chief Minister:

 

  • Mr Gerald White,
  • Mr Jason Turner

Nominations to the Jersey Teachers Superannuation Fund (JTSF) Committee of Management

 

 

  1. Purpose of the Report

 

1.1.      The Treasury Minister is asked to recommend nominees to the Chief Minister for the reappointment of the Management Board of the Jersey Teachers’ Superannuation Fund (JTSF).

 

  1. Background

 

2.1. Under the Teachers’ Superannuation (Administration) (Jersey) Order 2007 Article 3 – Appointment of members of management Board, the Chief Minister shall appoint to be members of the Management Board:

 

2.2. 6 Employer representatives of whom –

 

  • 2 shall be persons recommended by the Minister for Treasury and Resources;
  • 2 shall be persons recommended by the Minister for Education;
  • 2 shall be any persons that the Chief Minister thinks fit; and

 

2.3. 6 Member representatives, who shall have been selected in the manner that the Chief Minister shall agree with the associations that appear to the Minister for Education to represent the interests of teachers.

 

2.4. Members of the Management Board shall hold office for 3 years and shall be eligible for re-appointment. The Chief Minister may at any time remove from office any member of the Management Board appointed by him or her under this Article.

 

  1. Process

 

3.1. The current term of office for Mr Jason Turner and Mr Gerald White comes to an end in December 2021 and both have expressed a desire to continue

 

3.2. These employer nominees were selected following a formal recruitment process under the Appointment Commission Guidelines when first appointed and are eligible for re-appointment.

  1. Recommendation

 

4.1. The Minister for Treasury & Resources is recommended to nominate to the  Chief Minister the re-appointment of Mr Jason Turner and Mr Gerald White to the Management Board of the Jersey Teachers’ Superannuation Fund for a further 3 year term commencing 1st January 2022.
