Seaview, Les Charrieres de Maloret, St. Lawrence - notice of intent

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

This report has been prepared by the Jersey Heritage Trust as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the registration of historic buildings and sites.

 

The Planning and Environment Department requested that the Jersey Heritage Trust assess the architectural, historical and other interests of Seaview ahead of discussions with the Ministerial Registration and Listing Advisory Group.

Relevant interests of the site

 

Seaview was included in 1992 historic buildings register as grade 1, and confirmed as a proposed Site of Special Interest by the Jersey Building Heritage Sub-Committee in 2001.

 

Seaview is of special architectural, historical and archaeological interest. It is an historic farmstead with a complex of buildings - dating from the 16th to the 19th centuries - of great importance for the history and architecture of the Jersey farm (see SSI schedule for detail)

 

Advice received (MRLAG or others)

 

Seaview was considered by MRLAG at its meeting on 10 December 2007. Members unanimously agreed that the farmstead should be listed as a Site of Special Interest. 

 

JHT recommendation

 

Seaview is of special historical, architectural and archaeological interest and should be listed as a Site of Special Interest.   

 

It is recommended that the Minister for Planning and Environment approve the serving of the Intention to List Notice in accord with the requirements of the Law.

 

Justification relating to criteria

 

The special interest of Seaview, as defined and assessed relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002
