Assistant Ministers - Appointment of

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Chief Minister’s Department – Appointment of Assistant Ministers.  

Decision(s): The Chief Minister appointed Senator Sir P.M. Bailhache and Senator P.F. Routier as Assistant Ministers in the Chief Minister’s Department.

 

The Chief Minister also agreed that Senator Bailhache would assume the position of Chairman of the reconstituted Legislation Advisory Panel.

Reason(s) for Decision: Under Article 25 (a) and (b) of the States of Jersey Law 2005, the Chief Minister may appoint no more than 2 elected members as his or her Assistant Ministers, and remove any of his or her Assistant Ministers.

The Chief Minister has agreed that he wishes to appoint Senator Sir P.M. Bailhache and Senator P.F. Routier as his Assistant Ministers in the Chief Minister’s Department.

 

Both Assistant Ministers will share responsibility for external relations, reflecting the need to increase external engagement and provide assistance to the Chief Minister in developing external relations.

 

The Chief Minister also wishes Senator Routier to maintain his responsibility for migration policy and to assume responsibility for developing social policy across the States.

 

Senator Bailhache will take on responsibility for Machinery of Government Reform and will also chair the reconstituted Legislation Advisory Panel. 

 

A separate Ministerial Decision will follow detailing the functions delegated to each Assistant Minister under Article 28 of the States of Jersey Law 2005.

Resource Implications:  There are no financial or resource implications.

Action required: The Chief Minister will inform both Senator Bailhache and Senator Routier of their appointments as Assistant Ministers.

The Chief Minister will also inform the States Assembly of the appointments as part of a separate Ministerial Decision (MD-C-2011-0140), which will confirm the appointment of Ministers’ Assistant Ministers.
