Chairperson to the Community Relations Trust.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Appointment of the Chairperson to the Community Relations Trust

Decision(s):

The Minister approved the proposition for the appointment of Dr Elena Moran as the Chairperson to the Community Relations Trust, in pursuance of paragraph 5.1 of the Constitution of the Jersey Community Relations Trust, as amended.

Reason(s) for Decision:

Paragraph 5.1 of the Trust Constitution requires that the Minister shall recommend to the States the appointment of a Chairman. The Minister recommends the appointment of Dr Elena Moran, following her nomination by the Community Relations Trust Board on September 3rd 2008.

Resource Implications:

There are no resource implications to the Home Affairs Department resulting from this decision.

Action required:

The Minister requested the Greffier of the States that the proposition be lodged immediately for debate on 21st October 2008.

PROPOSITION

 

THE STATES are asked to decide whether they are of opinion  -

 

to appoint, in pursuance of paragraph 5.1 of the Constitution of the Jersey Community Relations Trust, as amended 

 

(a) Dr Elena Moran as the Chairman of the Jersey Community Relations Trust

 

 

for a period of three years from the date of appointment.

REPORT

 

The Constitution of the Jersey Community Relations Trust, as amended by the States on 20th January 2004, sets out the aims of the Trust as follows 

 

“To seek to eliminate discrimination on any ground including, but not limited to, grounds of colour, race, nationality or ethnic or national origins, gender or sexual orientation, disability or age, by promoting good relations between all members of society, and seeking to achieve equality of treatment and opportunity within our community”.

 

The Objectives are further specified in paragraph 3 of the Trust Constitution, as follows 

 

(a) To encourage mutual respect among all people in the Island.

 

(b) To promote equality of treatment and opportunity.

 

(c) To encourage and facilitate partnerships which enhance social harmony.

 

(d) To identify areas where discrimination arises, while promoting and encouraging existing and future initiatives to tackle it.

 

(e) To promote education in the community about the aim of the Trust.

 

(f) To promote recognition and acceptance of cultural diversity.

 

(g) To promote training in furtherance of the aim of the Trust and the development thereof.

 

(h) To provide information and advice and facilitate initiatives concerning discrimination.

 

(i) To sponsor and support research in furtherance of the aim of the Trust.

 

(j) To take measures to counter discriminatory behaviour, attitudes, and policies.

 

(k) To monitor these objectives.

 

Appointment of Chairman

 

Paragraph 5.1 of the Trust Constitution requires that the Minister shall recommend to the States the appointment of a Chairman. The Minister recommends the appointment of the Dr Elena Moran, following her nomination on September 3rd 2008.

 

The experience and qualifications of Dr Moran with regard to this appointment are as follows  

Professional Experience:  

2003 – current Crill Canavan – advice and litigation large scale commercial disputes; acting in trust disputes; contentious and non-contentious employment matters; advising on company law and protection of minority interests; dealing with professional negligence claims.

1994 – 2002 BBC Litigation Department

1992 – 1994 British Gas PLC 

Voluntary Work:  

2007 – 2008 Chairperson Silverstar Pre-School, St Mary

1989 – 1994 Legal Advice Worker, Hoxton Hall Community Centre

1990 – 1992 Advocate, Free Representation Unit

 

Appointment of further Trustees

 A States appointed Trustee is to be nominated; vacancies are to be advertised by the Community Relations Trust for two further Trustees.
