Importation of Live Poultry.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister removed the temporary ban on import of all live poultry from UK following confirmation of H5 Avian Influenza in Suffolk, England. Retain import ban on poultry from Avian Influenza Restricted Zone in line with EU legislation.

Reason(s) for Decision: 

Information received from Defra indicating no contacts between the Infected Premises and other areas of UK outside Avian Influenza Restricted Zone. No further outbreaks of disease have been detected.

Purpose of the Report  

To demonstrate protective measures for Jersey’s domestic poultry and other birds e.g. Durrell collection, from incursion of a notifiable disease, Avian Influenza, while permitting poultry businesses to restock from a disease free area of UK. 

Background 

On 12 November H5 strain of Avian Influenza virus was confirmed on premises in Diss on Norfolk/Suffolk border, England. An immediate ban on the import of live poultry was imposed by withdrawing current licences until further information became available. On 13 November the strain was confirmed as H5N1. No further outbreaks have been detected. 
 
Licensed imports of live poultry to Jersey are accompanied by a veterinary health certificate. 

Discussion 

Avian Influenza can cause enormous losses to the poultry industry and could have serious consequences for endangered species if confirmed in Jersey. The disease is spread chiefly through movement of infected birds or contaminated equipment or personnel. Information from Defra has confirmed no movement of poultry, personnel or equipment have taken place from the Infected Premises to premises outside the Restricted Zones in Norfolk and Suffolk. 

Movements of live poultry are permitted from areas of UK outside the Restricted Zone to EU Member States following veterinary inspection and certification. 

Conclusion  

Following receipt of this information and no further outbreaks of disease it is reasonable to permit licensed imports of live poultry from outside the Restricted Zones.

Failure to permit such movements would have serious financial implications for local businesses which restock from flocks in UK to a pre-planned program. 

Recommendation  

Agree that live poultry may be imported in accordance with licence conditions from outside the Restricted Zones.
