Drainage Law Policy in Respect of Private Developments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister rescinded MD-T-2007-0092 and re-confirmed the previous policy of not using the Drainage (Jersey) Law 2005 to serve notice on third party landowners for the benefit of private developers, to enable developers to lay sewers across third party land.

Reason(s) for Decision:  A debate in the States on a Proposition that essentially requested that this policy be maintained was supported by a majority of States Members.

TRANSPORT AND TECHNICAL SERVICES  

DRAINAGE LAW POLICY IN RESEPCT OF PRIVATE DEVELOPMENTS  
 

Purpose of the Report  

To re-confirm a departmental policy in respect of serving a legal Notice under the Drainage (Jersey) Law 2005 on behalf of a private developer or individual. 

Background  

In November 2007, the Minister made a Ministerial Decision, MD–T-2007-0092, to vary the policy on using the Drainage (Jersey) Law 2005 to serve Notice on third party landowners for the benefit of developers and private individuals. 

The new policy would have allowed the serving of Notice to be considered if a Public gain could be demonstrated, namely, if the developer or individual was willing and able to connect additional surrounding properties to the public foul sewer network at his own expense. Under the previous policy, such requests by a developer or individual to serve Notice in this way would not have been entertained.  

The Ministerial Decision prompted Senator Ben Shenton to take a Report and Proposition to the States requesting the Minister for Transport and Technical Services to rescind the decision.   

Discussion  

The States debate on the proposition was held on 3 June 2008, and the proposition was supported by a large majority of States Members. 

Given the result of the debate, it is believed that it is now appropriate to re-confirm the original policy on the use of the Drainage Law on behalf of developers or private individuals. In essence, the Minister will not use his powers under the Drainage (Jersey) Law 2005 to serve notice on third party land owners for the benefit of developers or private individuals.  

Conclusion  

A Proposition was debated in the States on 3 June 2008 which asked the Minister for Transport and Technical Services to rescind a Ministerial Decision made in November 2007. 

The Ministerial Decision, MD-T-2007-0092, would have permitted the use of the Drainage (Jersey) Law 2005 for the benefit of developers or private individuals to be considered if a public gain could be demonstrated. 

The Proposition was supported by a large majority of States Members.     
 

 

Recommendation  

The Minister is recommended to reconfirm the previous policy of not using his powers under the Drainage Law (2005) to serve notice on third party land owners for the benefit of developers or private individuals.
