Authority to Enter Premises, Environmental Health Officers.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

In accordance with the attached report the Minister is recommended to approve the authorisation to enter premises for the following Officer in respect of Legislation 1-8 listed in the attached report

Valerie Cameron, Team Leader – Public Protection

to enter any premises at all reasonable hours for the purpose of their official duties in pursuance of the statutory provisions listed above in that behalf.

Reason(s) for decision:

Staff of the Health Protection Service must possess a document authorising them to enter premises in pursuance of the delegated duties under the various Public Health Legislation.

TITLE Authority to Enter Premises – Officer of Health Protection

Background

It is recognised for staff to undertake their duties in an appropriate manner they need to possess a document authorising them to enter premises in pursuance of their duties under the various Public Health legislation, with the proviso that those officers titled Health Protection Technicians are only authorised to enter premises under associated Public Health legislation as the Public Health Law 1934 expressly precludes them from having statutory power of entry.

In all cases the document is to be supported by the Health and Social Services security card as a means of proving identity and engagement by the then Committee.

Laws for which Authorisation of Officers is required from the Minister:

  1. Article 10 – Public Health Law 1934 (EHO’s only)
  2. Article 1 - Statutory Nuisances (Jersey) Law 1999
  3. Article 7 - Piercing and Tattooing (Jersey) Law 2002
  4. Article 1 – Food Safety (Jersey) Law 1966
  5. Article 5(9) - Food Safety (Miscellaneous Provisions) Law 2000
  6. Article 3 – Burials and Exhumation (Jersey) Law 2004
  7. Article 3 - Public Health (Vessels and Aircraft) (Jersey) Law 1950
  8. Article 1(F) – Restriction on Smoking (Jersey) Law 1973

Issues

Since the last set of authorizations issued by the Minister for Health, the Health Protection Service has recently engaged a new member of staff to be the Team Leader for the Public Protection Team. The new member of staff is;

The Minister is recommended to approve the authorisation of the following Officer in accordance with the legislative requirements;
