Budget transfer: Transfer of Sport and Culture Budget to Economic Development Department (P.46/2015)

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed to the budget transfer in 2016, following the adoption by the Assembly of P.46/2015 being the transfer of the Sport and Culture budget from the Education, Sport and Culture Department to the Economic Development Department, and seeks approval from the Minister for Treasury and Resources.

Reason(s) for Decision:

Article 18(1)(b) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be transferred from one head of expenditure to another head of expenditure consequentially upon a transfer of functions by Regulations made under Article 29 of the States of Jersey Law 2005.

 

The States adopted P.46/2015, Draft States of Jersey (Transfer of Functions No. 8) (Miscellaneous Transfers) (Jersey) Regulations 201- (principles adopted on 20th October 2015), on 16th December 2015.

Resource Implications:

There are no resource implications other than the transfer between departments as detailed in the Written Report.

Action required:

The Minister for the Education, Sport and Culture Department to seek approval from the Minister for Treasury and Resources for the above described budget transfer. The Head of Decision Support to notify the Executive Support, Chief Minister’s Department that the Decision has been approved.

TRANSFER OF FUNCTIONS BUDGET TRANSFER AS PER P.46/2015

 

  1. Purpose of Report

To enable the Minister for Education, Sport and Culture to request that the Minister for Treasury and Resources approves a recurring budget transfer in 2016 following the adoption by the Assembly of P.46/2015.

 

  1. Background

The Chief Minister lodged proposition P.46/2015 with the intention of underpinning the Draft Strategic Plan 2015 -2018 and in particular, the need to:

 

  • deliver positive, sustainable economic, social and environmental outcomes for Jersey;
  • ensure effective, efficient and sustainable management and use of public funds; and
  • ensure the provision of modern and highly valued services for the Public.

 

3.  Budget Transfers

The following transfer is to occur,

 

  • £8,108,922, being the Sport and Culture budget, from the Education, Sport and Culture Department to the Economic Development Department together with 106.5 FTEs
