Transport and Technical Services: 2010 Increases to Fees and Charges

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  To approve the increases to the Department’s fees and charges as set out in the attached schedule.

Reason(s) for Decision:  To enable the Department to increase its fees and charges in 2010 in line with the Anti-Inflation Strategy agreed by the States and to allow the department to achieve the Departmental savings as per the 2010 States Annual Business Plan.

This Ministerial Decision excludes the charges for the Abattoir, the Knackers yard and Jersey Car Parks which will be under a separate Ministerial Decision in due course. 

Resource Implications:  Cost of advertising increases to fees and charges in the Jersey Evening Post.

TRANSPORT AND TECHNICAL SERVICES  

INCREASES TO FEES AND CHARGES  

Purpose of the Report  

The Minister for Transport and Technical Services is asked to approve a request to increase the Department’s various fees and charges for 2010 (a schedule of charges is attached as Appendix A). 

Discussion  

The majority of the proposed increases have been limited to 2.5% per annum in accordance with the States Anti-Inflation Strategy.  

The charges which have been increased over and above 2.5%, namely the clinical waste disposal fee and the bus charges, have been increased as agreed in the 2010 States Annual Business Plan in order to achieve the departmental savings which the Department was charged with achieving.  The Health and Social Services Department (largest users of the clinical waste facility) have been notified of the proposed increased of 13.9%. 

It is proposed that the following fees and charges are not increased for the reasons detailed below.   

Segregated inert waste

There is a current lack of stone; by keeping the charge at 2008 prices this may encourage more stone.

Motor cycles (CBT)

There is an agreement that the fee for CBT will increase each January by RPI as at the previous September. June 2009 RPI was -0.4%, assumption September RPI will remain at a similar rate.

International driving permits

Issued by the parish, retain a £10.00 flat fee.

The Minister gave an undertaking to taxi drivers when he decided not to grant a fare increase this year that he would not increase fees and charges.

 

The fees and charges for the Abattoir, the Knackers yard and Jersey Car Parks have not been included as part of this Ministerial Decision but will be brought to the Minister for consideration in due course. 

In accordance with Finance Direction No.4.1 Increases in States Fees and Charges, all increases to charges above 2.5% require the approval of the Minister for Treasury and Resources.   The Treasurer of the States can approve increases to States charges under his delegated powers, where those increases are non-contentious.   

Recommendations 

The Minister is recommended to approve the increases to the Department’s fees and charges as set out in the attached schedule which are due to take effect from 1st January 2010 and seek the approval of the Treasurer of the States to any increases above 2.5%.
