La Collette Energy from Waste Facility - appointment of a construction phase architectural adviser

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TRANSPORT AND TECHNICAL SERVICES  

APPOINTMENT OF ARCHITECTURAL ADVISER  
 

Purpose of the Report  

To formally appoint Hopkins Architects Limited as Architectural Design Adviser for the La Collette Energy from Waste Project. 
 

Background  

Condition 9 of the Planning Consent for the La Collette Energy from Waste Facility (RM/208/2086) requires that the Minister for Transport and Technical Services as “applicant”  

      “retain Hopkins Architects Limited, or other such architect approved in writing  by the Minister for Planning and Environment, throughout the detailed design  and construction period until the plant is commissioned to ensure that the  detailed design and final construction conform to the final Hopkins design as  hereby approved and the approved statement of architectural requirements.” 
 

Discussion  

Following extensive negotiations with Hopkins Architects Limited as to the scope, conditions of contract and legal status of a proposed contract, that company has now agreed a form of adviser appointment and contract.  

The agreed contract includes novation arrangements in the event that Hopkins Architects Limited becomes a Limited Liability Partnership, which they have indicated they intend to do. The agreed contract also includes a Deed of Variation to acknowledge a change in the Construction Design Management Coordinator for the project during the period during which contractual arrangements with Hopkins Architects Limited have been under discussion. 

A fixed fee could be negotiated with the company. Instead a capped monthly sum and indicative overall budget plus schedule of fees have been agreed. The indicative total cost of the appointment is anticipated to be £72,973. 
 

Conclusion  

The Minister for Planning and Environment indicated that the Minister for Transport and Technical Services should appoint an architect of international repute to re-design the La Collette Energy from Waste Facility and has made their appointment a condition of the Planning Consent. 
 

Recommendation  

The Minister is recommended to approve the appointment of Hopkins Architects Limited as Architectural Design Adviser for the Construction Phase of the La Collette Energy from Waste Facility.

To ensure that the detailed design and final construction conform to the final Hopkins architectural design as approved within RM/208/2086 and the approved Statement of Architectural Requirements. 
 

Action Required  

The Minister is requested to sign and seal the attached Contract and Deed of Variation.
