Category 'A' Housing Development at Bel Royal – Request for Further Phased Development.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

A written request from the developer for the immediate release of Blocks 6, 7,13 and 19 and various garage blocks for construction, in advance of the Planning Obligation Agreement being completed, as part of the planned phased release of the remaining blocks.

Decision(s):

The Minister decided to permit the release of Blocks 6, 7, 13 and 19 and various garage blocks for construction under part (c) of Planning Condition No.3 attached to the original Planning Permission, on the understanding that:

  • none of the homes can be occupied until the required Planning Obligation Agreement has been completed and registered; and
  • the developers carry out these works in advance of the Agreement at their own risk.

Reason(s) for Decision:

  1. to assist with the provision of homes to meet the Island’s identified requirements;
  2. to help secure the orderly development of the site;
  3. to avoid the developer potentially having to lay off a significant proportion of its workforce;
  4. to help maintain the pressure for completing, as expeditiously as possible, the required Planning Obligation Agreement in the Public Interest.

Action required:

1. Inform the land owner and local political representatives of the Minister’s decision;

2. Remind the land owner of the importance the Minister attaches to the completion of the required Planning Obligation Agreement at the earliest opportunity.

3. Request the Crown Officers to provide the Minister with a form of words to accompany the possible further release of homes for construction in advance of the completion of the Planning Obligation Agreement, in order to guarantee the Minister’s position and that of the Public Interest.

N.B. The Minister, in the light of the response from the Crown Officers, has subsequently decided to inform the land owner that he would not be minded to release the remaining blocks for construction in advance of the Planning Obligation Agreement being completed and registered.
