Independent Prison Monitoring Board (IPMB): Reappointment of Chair

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

 

The Minister for Home Affairs reappointed Vivien Vibert as Chairperson of the Independent Prison Monitoring Board (IPMB).

 

Mrs Vibert was originally appointed as a Member of the Board on 18 April 2017 for a four year term and has served as Chairperson since April 2018. She has indicated her wish to continue to serve as Chairperson until the end of 2021, and as Member for a further four-year term.  The Minister therefore reappoints her for a further four year term effective from 18 April 2021, and arrangements will be made to recruit a new Chairperson later in 2021.

 

The Minister thanks Mrs Vibert for her dedicated service as Chairperson and wishes her well for another term in office.

Independent Prison Monitoring Board (IPMB): Reappointment of Chair

REPORT: Reappointment of Chairperson of the Independent Prison Monitoring Board

The Independent Prison Monitoring Board was established in April 2017 according to The Prison (Independent Monitoring Board) Regulations (‘The regulations’).

The Regulations provide that the Board must satisfy itself of:

(a)     the treatment and welfare of the prisoners;

(b)     the state of the premises of the prison; and

(c)     the administration of the prison.

In 2019 the Board carried out 25 Monitoring Visits to HMP La Moye and looked into 27 applications made by Prisoners at HMP La Moye.

The IPMB provides a vital safeguard to ensure the correct treatment of people detained at HMP La Moye and is a central feature of the island’s move towards demonstrating compliance with the UN Optional Protocol to the Convention Against Torture (OPCAT) requirements.

Vivien Vibert was appointed to the Board as a member in April 2017 for an initial term of four years.

Following the resignation of the previous Chairperson, Vivien acted as interim Chair from April 2018 and was formally appointed Chairperson in December 2018 following an internal recruitment process culminating in a three-person interview panel.

Her current membership of the Board is due to expire in April 2021, and Mrs Vibert has indicated she wishes to be reappointed for a further four years.
