Jubilee Wharf - Budget Transfers between Departments.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of budgets to the Economic Development Department and Chief Minister’s Department from the Housing Department for occupation costs of Jubilee Wharf.

Decision(s): The Minister approved the transfer of funds from the Housing Department as follows: £147,000 to the Economic Development Department and £47,900 to the Chief Minister’s Department and reduction of the Housing Cash limit by £194,900 (MD-H-2009-0072, MD-E-2009-0118, Delegated Decision by Mr W. Ogley)

Reason(s) for Decision: To ensure compliance with Financial Direction 3.6 and to ensure that the cash limits of Housing, Economic Development and Chief Minister are accurate due to Jubilee Wharf now being occupied by 3 departments. In pursuit of proper accountability each Department will be responsible for its own costs in relation to occupation of the premises.

Resource Implications: Housing cash limit to decrease by £194,900 and Economic Development and Chief Minister Department cash limit to increase by £147,000 and £47,900 respectively in 2009.

This transfer has now been included in the 2010 Draft Annual Business Plan.

Action required:

Treasury to advise Finance Directors of each Department of Minister’s approval.

TREASURY AND RESOURCES MINISTER  

TRANSFER BETWEEN REVENUE HEADS OF EXPENDITURE

 

  1. Purpose of Report

To enable the Minister for Treasury and Resources to approve the transfer of the budget for Jubilee Wharf to Chief Minister’s and Economic Development Department from the Housing Departments in 2009. 

  1. Background

Financial direction 3.6 requires certain budget transfers to be approved by the Minister for Treasury and Resources. 

  1. Comments

Requests have been made for the transfer between Housing and both the Chief Minister’s and Economic Development to ensure that the cash limits for all three departments are accurate and that the costs of Jubilee Wharf are properly apportioned across the user Departments thus facilitating proper accountability.

In all cases approvals of transfers have been obtained, see attached (MD-H-2009-0072 and MD-E-2009-0118 and Delegated Decision by Mr W. Ogley. This transfer has been included in the Draft Annual Business Plan 2010 to ensure a permanent transfer.

That the Minister approves the transfers as detailed on the decision template.
