Increase in fees for fisheries licences

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

To replace Sea Fisheries (Fees)(Jersey) Order 2006 with Sea Fisheries Fees)(No2)(Jersey)200_

Reason(s) for decision:

In line with States Policy to increase fees in line with inflation, Article 1 of the Order takes into account the increase from £81.50 to £83.50 for a fishing boat licence and Article 2 takes into account the increase in fees for scallop permits from £15.00 to £15.50 for taking a maximum of 24 scallops per day and from £70.00 to £73.50 for the taking of unlimited quantities per day.

Action required:

Greffier of States to arrange for order to be laid before the States.

After Ministerial approval, the Sea Fisheries (Fees)(No2)(Jersey)200_ to be sent to Angela Rayson, States Greffe, who will arrange for the publication in the Jersey Gazette of the necessary notice of making the Order.

Increase in fees for fisheries licences

Sea Fisheries (Fees) (No. 2) (Jersey) Order 200-

Explanatory Note

This Order increases by 2.4% the fishing boat licence fee (a fee that was last increased early in 2006) and by 5% and 3% the scallop permit fees (fees that were last increased at the end of 1999).

The Order was made on and comes into force on 1st January 2007.

THE MINISTER FOR PLANNING AND ENVIRONMENT, in pursuance of Regulation 7(5) of the Sea Fisheries (Licensing of Fishing Boats) (Jersey) Regulations 2003 and Regulation 3 of the Sea Fisheries (Underwater Fishing) (Jersey) Regulations 2003, orders as follows –

1 Charge for fishing boat licence

For the purposes of Regulation 7 of the Sea Fisheries (Licensing of Fishing Boats) (Jersey) Regulations 2003, the prescribed charge for the grant of a fishing boat licence under Article 12 of the Sea Fisheries (Jersey) Law 1994 is £83.50 (whether the licence is a class A licence or a class B licence).

2 Fees for scallop permits

For the purposes of Regulation 3 of the Sea Fisheries (Underwater Fishing) (Jersey) Regulations 2003, the prescribed fee for the grant of a permit to take scallops is –

(a) if the permit is for the taking of scallops in unlimited quantities – £73.50; or

(b) if the permit is for the taking of a maximum of 24 scallops per day –£15.50.

3 Revocation

The Sea Fisheries (Fees) (Jersey) Order 2006 is revoked.

4 Citation and commencement

This Order may be cited as the Sea Fisheries (Fees) (No. 2) (Jersey) Order 200- and shall come into force on 1st January 2007.
