Approval of Report and Proposition in respect of Deed of Arrangement - Brompton Villa.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT FOR HOUSING MINISTER

APPROVAL OF REPORT & PROPOSITION

IN RESPECT OF DEED OF ARRANGEMENT

BETWEEN THE PUBLIC AND HEBDEN LIMITED

Brompton Villa was purchased by the Public of the Island in November 1959 and is presently administered by the Department as social rented accommodation.

In June 2007 Hebden Limited bought the neighbouring property ‘Belize House’. Prior to the sale, discussions between the Public and Hebden Limited has established that the deeds for Brompton Villa and Belize House did not accurately describe the boundary between the two properties and it was therefore agreed that the Public shoul be party to the sale in order to regularize the position in the most expedient manner.

Hebden Limited subsequently passed contract in respect of the purchase without requiring the Public to be party and for that reason the boundary arrangements are still not properly recorded.

The Public have now been approached by Hebden Limited to rectify the matter by way of the passing of a Deed of Arrangement, which will require the approval of the States Assembly, a process which would have been unnecessary had the Company followed advice in respect of having the Public party to their purchase. This has added costs for the Public in preparing a Report and Proposition to be lodged by the Treasury & Resources Minister for the States to consider and accordingly both the Housing and Property Holdings Departments are making additional charges amounting to £1,000 to reflect officer time, over and above the Public’s reasonable legal costs which Hebden Limited are bound in any case to pay.
