Road Traffic (St. Helier) (Jersey) Order 1996 - Temporary Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the change of the times of loading and unloading in the two unloading bays situated in Union Street, between Dumaresq Street and New Street from 5.00am – 6.00pm to 5.00am - midnight.     

 

Reason(s) for Decision: To change the times of loading and unloading in the two unloading bays to facilitate local traders who operate during the evening, and require short term loading and unloading facilities.

 

Resource Implications: Jersey Gazette notice - £80. Sign marking changes - £30. Officers time - four hours.

 

Action required: The Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956.

UNION STREET TEMPORARY AMENDMENT TO CHANGE THE TIMES OF LOADING AND UNLOADING IN THE TWO UNLOADING BAYS SITUATED BETWEEN DUMARESQ STREET AND NEW STREET

 

 

Purpose of the Report

 

To make a temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996

 

 

Background

 

On 01 April 2009 the Minister for Transport and Technical Services approved an oral report from the Director of Municipal Services, after consultation with the Connétable of St Helier, and subject to public consultation, for a temporary amendment to the Road Traffic (St Helier) (Jersey) Order 1996.  The temporary order to be made under Article 68 of the Road Traffic (Jersey) Law 1956 for a period not exceeding 12 months, is to change the times of loading and unloading in the two unloading bays situated in Union Street, between Dumaresq Street and New Street from 5am - 6pm to 5am - midnight.

 

Article 68 enables changes to Traffic Orders to be made, for a period of up to 12 months, without waiting for the relatively lengthy process of amending Orders to be completed.  During the 12 month period an amendment to the Order will be drafted, for approval by the Minister.

 

 

Discussion

 

The requested change of the times of loading and unloading in the two unloading bays is to facilitate local traders who operate during the evening, and require short term loading and unloading facilities.  At a meeting on 04 March 2009 between TTS and the Parish of St Helier Roads Committee the changes were requested.

 

Following the posting of public consultation notices in the vicinity of the unloading bays, emails were received from two members of the public who are not in support of the changes. These emails are included with this report together with a draft Jersey Gazette notice, and plan of the location of the proposal.

 

 

Recommendation

 

In consideration of the objections to the proposed change of unloading times, the Minister is requested to decide whether to approve the attached notice.  If approval is granted, the change will come into effect within seven days after its insertion into the Jersey Gazette.

If approval is granted the Minister to instruct his officers to arrange for a notice to be inserted in the Jersey Gazette, as required by Article 68 of the Road Traffic (Jersey) Law 1956, on two occasions during the seven days immediately preceding the date on which it is to have effect.
