Criminal Injuries Compensation Board: Appointment of members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

The Minister for Home Affairs appointed Mrs Rebecca Young, Mr Peter Charalambous and Mrs Jess Doyle as non-legally qualified (lay) members of the CICB.

 

These appointments bring the total membership to 12, the maximum number under the Scheme.

 

All of the above appointments are effective from 18th April 2018 following a period of initial induction and are for an initial period of five years.

 

This appointments process has been undertaken in accordance with Jersey Appointments Commission guidelines.

 

 

RESOURCE IMPLICATIONS:

Membership of the Board is undertaken on an honorary basis, and accordingly there are no resource implications as a consequence of this decision.

Report for the Home Affairs Minister

 

Background

 

The Criminal Injuries Compensation Scheme is administered by the Criminal Injuries Compensation Board. The scheme was most recently amended in April 2015 and can be viewed via the following link:

The Scheme provides that the Board will consist of not more than twelve members, not less than three of whom shall be advocates or solicitors of the Royal Court of not less than five years’ standing. Members of the Board are appointed by the Minister for Home Affairs, for five years in the first instance, and their appointment is renewable for such periods as the Minister may think appropriate. One Member, who is an advocate or solicitor of not less than five years’ standing, is appointed by the Minister as Chairman of the Board.

To aid the work of the Board and to bring its membership to its maximum of 12 members, an open recruitment process has been undertaken for non-legally qualified (lay) members of the Board. This process has been undertaken in accordance with Jersey Appointments Commission guidelines and has resulted in the following recommended appointments:
