Grantez Farm self-catering apartments, St. Ouen - removal of tourism registration

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister, acting in accordance with Article 15 of the Tourism (Jersey) Law 1948 approved the cancellation of registration of the Grantez Farm Self Catering Apartments on the grounds that the premises has ceased to be qualified for registration in the register in which they are registered. This cancellation will be effective from 31st December 2009.

  

Reason(s) for Decision:

Following the successful application to Planning and Environment for the change of use from Tourist Accommodation under the Tourism (Jersey) Law 1948 to Lodging Accommodation under the Lodging Houses (Registration) (Jersey) Law 1962 the cancellation of registration from the Tourism (Jersey) Law 1948 is necessary as part of this transition of change of use.  

Resource Implications:

Loss of annual income from the registration of this Tourism establishment registered under the Tourism (Jersey) Law 1948.

Action required:

The Hospitality and Leisure Manager to notify the proprietor of the Grantez Farm Self Catering Apartments of the cancellation of registration from the Tourism Law.  He will also notify the officer responsible for the Lodging House Registration, Jersey Tourism Senior Management, States of Jersey Fire and Rescue and Health Protection.

Cancellation of Registration of the Grantez Farm Self Catering Apartments, St Ouen, from the Tourism (Jersey) Law 1948  

Following the successful application by the proprietors of the Grantez Farm Self Catering Apartments to Planning and Environment for the change if use from Tourist Accommodation, under the Tourism (Jersey) Law 1948, to Lodging Accommodation, under the Lodging Houses (Registration) (Jersey) Law 1962, and subsequent confirmation from the proprietors that they will leave the Tourism Self-Catering sector on 31st December 2009 and transfer to residential lodging accommodation.  It is necessary to cancel the registration of the aforementioned establishment from the list of registered accommodation under the Tourism (Jersey) Law 1948. 

The Minister, acting in accordance with Article 15 of the Tourism (Jersey) Law 1948 may at any time cancel the registration of any registered premises and withdraw the relevant registration certificate on the grounds that the premises have ceased to be qualified for registration in the register in which they are registered.  

It is recommended that the Minister, acting in accordance with Article 15 of the Tourism (Jersey) Law 1948 approves the cancellation of registration of the Grantez Farm Self Catering Apartments on the grounds that the premises has ceased to be qualified for registration in the register in which they are registered. This cancellation will be effective from 31st December 2009. Once cancelled this will allow the aforementioned it to be registered under the Lodging Houses (Registration) (Jersey) Law 1962. 

On approval of the cancellation the Hospitality and Leisure Manager will notify the proprietor of the Grantez Farm Self Catering Apartments of the cancellation from the register.  He will also notify the officer responsible for Lodging House Registration, Jersey Tourism Senior Management, States of Jersey Fire & Rescue and Health Protection.
