Economic Stimulus Plan - St. Aubin's Pier Repair.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Economic Stimulus Plan: budget allocation to Jersey Harbours in relation to pre-construction design and planning spend on the St Aubin’s Pier project.

Decision(s):

The Minister approved the allocation of £70,000 to Jersey Harbours, to be transferred to the department’s 2009 budget. 

He further instructed the civil infrastructure project team to report on spend of all stimulus monies, and project progress/performance, on a monthly basis in accordance with guidelines set by the Treasury.

Reason(s) for Decision:

A discretionary fiscal stimulus allocation from the Stabilisation Fund of £44m has already been approved. The approved funding to Jersey Harbours of £70,000 will enable the civil infrastructure project group to progress design and preparatory works on the St Aubin’s Pier project in accordance with the critical path for delivering this stimulus project on a timely basis.

Resource Implications:

No resource implications other than those already approved at the States’ debate (P55/2009) on 19th May 2009.

Action required:

Treasury to be informed of decision to release necessary funds to the Jersey Harbours budget.

Allocation of Fiscal Stimulus Funding to Civil Infrastructure Project Team  

Report summarizing recommendations of the Fiscal Stimulus Steering Group

2 nd September 2009  

Background  

9 civil infrastructure projects are included in the Treasury and Resources Minister’s “amber light” programme of fiscal stimulus projects.  

Included within that programme of 9 projects is a scheme to undertake major repair works to St Aubins Pier, and Jersey Harbours requires funds to commence the design and preparatory works prior to the commencement of construction in order to progress work in accordance with the project timetable.  

This project will provide work for local business and labour, and is programmed to be completed by Q2 2010, and is a significant project which will increase public sector spending and investment in Jersey’s infrastructure.    

Fiscal Stimulus Steering Group Recommendation  

Following discussion at the Fiscal Stimulus Steering Group meeting on 2nd September 2009, the Steering Group are making a recommendation to the Treasury and Resources Minister that £70,000 is allocated to Jersey Harbours to enable the civil infrastructure project group to proceed with the project and meet the estimated planning and design spend on the project, the money to be allocated to Jersey Harbours’ 2009 budget.
