Road Traffic (St. Saviour) (Jersey) Order 2000: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST SAVIOUR) (JERSEY) ORDER 2000 AMENDMENT REQUEST

 

 

Purpose of the Report

 

To amend the Road Traffic (St Saviour) (Jersey) Order 2000 introducing new ‘Prohibition of Waiting’ restrictions and ‘Disc Parking’ restrictions.

 

 

Background

 

Amendment to Schedule 3 ‘Prohibition of Waiting’

The Connétable of St Saviour wishes to make several changes to traffic restrictions across the Parish. The Parish wants to extend areas of ‘Prohibition of Waiting’ to prevent nuisance parking.

 

Amendment to Schedule 5 – ‘Duration of Parking on Certain Roads’

Remove all roads listed under this Schedule, to create a blank Schedule. Maintain the wording in the relevant Articles so that the option to reuse the restrictions remains open for future use.

 

Amendment to Article 7A ‘ Parking of Vehicles displaying parking discs’ and Schedule 6 ‘Disc Parking’

The Connétable wishes to amend Article 7A of the Order to include for the restriction of parking for a period in excess of 3 hours. This will allow for the subsequent Amendment to Schedule 6 to create separate parts for 2 hour and 3 hour Disc Parking.

 

 

Discussion

 

Amendments to Schedule 3 - Part 1 “Prohibition of Waiting” summarised below

Bagatelle Lane: - From its junction with Les Ametots for a distance of 52 yards in a northerly direction.

 

Grands Vaux: – North Side from its junction with Deloraine Road to a point 16 yards further east.

 

Clos Paumelle: - From the western side of the entrance of number 41 Le Clos Paumelle, in an easterly direction for a distance of 60 yards to the boundary of numbers 38 and 37 Le Clos Paumelle.

 

New York Lane: Remove existing wording and replace with:

 

  • North Side – from the eastern junction with Longueville Road in a westerly direction for a distance of 75 yards.
  • North Side – from the western junction with Longueville Road in an easterly direction for 14 yards.
  • North side - from a point 34 yards from the western junction with Longueville Road, to a point 87 yards further east.
  • South side – from the eastern junction with Longueville Road in a westerly direction for a distance of 55 yards.
  • South side - from the western junction with Longueville Road in an easterly direction for a distance of 112 yards.

La Rue de la Croix Besnard - Replace the existing definition with the new wording below:

 

North Side –

  • From its junction with Les Varines and Bagatelle Road for a distance of 31 yards in an easterly direction.
  • From a point 87 yards from the same junction for a distance of 13 yards
  • From its junction with La Rue de Beauvoir for a distance of 56 yards in a westerly direction.

 

South Side: - Entire length of the road.

 

Langley Park –

  • Amend existing wording to read “Both sides (from its junction with Grands Vaux) for a distance of 61 yards.
  • South Side from the beginning of the footway at the junction of Langley Avenue and Langley Park to a point 58 yards downhill.

 

Schedule 6 Disc Parking - Part 1 not exceeding 2 hours

Albert Road: In its entirety

 

Highlands Lane: -

  • The triangular parking area opposite number 32 Wellington Park.
  • North east side, from a point 48 yards from the junction with St. Saviours Hill for a distance of 46 yards in a south easterly direction.

Schedule 6 Disc - Parking Part 2 not exceeding 3 hours

 

The Parish would like to introduce a 3 hour Disc Parking to the permitted parking areas on -

  • Rue de la Fountain
  • Beach Road
  • New York Lane to have 3 hour parking period.

 

 

Recommendation

 

The Minister is requested to approve the request.
