Crematorium Charges: Increases for 2011

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the increase in cremation fees and Book of Remembrance and memorial card charges for 2011 and requested the law Draftsman to prepare the necessary Order.

Reason(s) for Decision:

1)  To reduce the cost of the service to the Health and Social Services Department.

2)  An Order made under the ‘Cremation (Jersey) Law 1953’ needs to be drafted and made by the

      Minister to reflect the proposed increased fees.

Resource Implications:

None.

Action required:

1)  Request the Law Draftsman to prepare an Order under the ‘Cremation (Jersey) Law 1953’ to

     reflect the proposed new charges.

2)  Director of Estates and Hotel Services to advise the Island’s funeral directors of the new charges,

     once the Order has been made by the Minister.

Crematorium - Proposed Charges for 2011

 

1. Background

 

1.1         The Crematorium charges for 2010 were approved by Ministerial Decision ref. MD-HSS-2009-0064 (copy attached Appendix A).

 

1.2         From 1st January 2010 the charges were increased by 69% to reflect the whole cost of cremation.

 

2. Present

 

2.1         The Minister is now required to approve charges for 2011 for an Order to be drafted under the ‘Cremation (Jersey) Law 1953’.

 

2.2         Any increase in charges of more than 2.5% per annum requires the approval of the Minister of Treasury and Resources under Codes of Directions No. 24. 

 

2.3         Due to the large rise this year it is recommended an increase of 2.1% is added to the present charges for next year, which matches the Jersey RPI in the 12 months to September 2010.

 

2.4         A comparison between charges made by Crematoria across the UK has been made which demonstrates Jersey in the ‘Crematorium Fee League Table’ is 64th out of 256 published charges in 2010 (see appendix )

 

2.5         It is therefore recommended that cremation charges are increased from £535.00 to £546.00 to reflect the Jersey RPI.

 

3. Recommendations

  

3.1        Cremation fees:

 

 The Minister is recommended to approve the fees as set out below, prescribed by Order made by the Minister for Health and Social Services under the provision of the Crematorium (Jersey) Law 1953.

 The Minister is recommended to request the Law Draftsman to arrange for the preparation of the necessary legislation to give effect to the variation in the fees from 1st January 2011.

 

3.2        Books of Remembrance and Memorial Cards:

 

 The Minister is further recommended to approve the following charges for the Book of Remembrance and Memorial Cards which have been increased by 2.1% and rounded up to the nearest 1p: -
